88 Francis the af.d twenty eight pounds Eleven shillings and one penny when thereto afterwards requir'd he would faithfully pay and Content and altho' the af.d Francis the sum of twenty one pounds four shillings and one of the af.d Sum twenty Eight pounds Eleven shillings and one penny to the same John hath since paid & satisfied Nevertheless as to seven pounds seven shillings and one penny residue the af.d Francis his promise and Assumption af.d in form af.d made little regarding but plotting and fraudulently intending the same John in this part Craftily and subtilly to deceive and defraud the said Sum of Seven pounds seven shillings and one penny or any part thereof to the said John hath not paid (altho' the same ^to^ do the said Francis the day and year af.d and often since at the County af.d by the same John was thereto required but the same to pay to to the same John hath hitherto altogether refused and still doth refuse to the damage of the same John twenty pounds Curr.t money of Maryland and thereof he brings Suit Pledg.s &.c J: Doe R: Roe
Whereupon at the prayer of the aforesaid John Wildman by his attorney afd the said Francis Porter is adjudged to give speciall bail to the action aforesaid Thereupon Came hereinto Court a Certain Francis Allen of Somerset County Gentleman in his proper person and undertook for the said Francis Porter [Likewise the said Francis Porter present here in Court in ^his^ proper person assumed upon himself] that If it should happen that Judgment in the plea af.d should be rendred for the same John against him the said Francis ^Porter^ or that he the same Francis ^Porter^ should be therein Convict that then he the said Francis ^Porter^ should pay and satisife unto the said John the Judgment the Judgment of the Court thereupon or render his body in Execution ^of such Judgment^ to the prison of the sheriffe of the County af.d in satisfaction thereof or that he the same Francis Allen will do the same for him &c And whereupon the said Francis Porter by George Douglas ^his attorney Comes and defends the force and Injury when &.a and^ prayeth leave thereof to Imparle here untill next Court |
