87 against him hath Complained and as to the damage of the same Francis by him by Occasion of the premisses in that part sustained the same William Whittington saith and acknowledgeth that the af.d Francis hath sustained Damages by Occasion of the premisses beyond his Costs and Charges by him about his suit in that part apposed to Seventy pounds fourteen Shillings Currt money of maryland and not more and because the af.d Francis denys not this but the same Allegations Grants to be true prays Judgment for those damages above acknowledged together with his Costs and Charges af.d to him to be Adjudged &.a Therefore by Consent of the parties af.d it is Considered that the af.d Francis Allen Recover against the af.d William Whittington his damages af.d to the af.d Seventy pounds fourteen shillings Currt money of maryland by the same William in form af.d acknowledged as also Two hundred and thirty 213 Six Pounds of tobacco for his Costs and Charges af.d to the same Francis at his request by the Court now here of the Assent of the parties af.d Adjudged which Certain damages in the whole amounts to Seventy pounds fourteen Shillings Currt money of maryland and Two hundred and Thirty Six pounds of tobacco with Stay of Execution untill August Court next Ensuing and the aforesaid William in Mercy &a
Dom one thousand seven hundred and forty to Answer unto John Wildman of a plea of trespass upon the Case &c and the same day is given to the af.d John here &c Att which day here Came the af.d John Wildman by William Arbuckle his attorney and the sheriffe to witt John Henry Gent now here returned that he had taken the af.d Francis Porter whose body here at this day he had ready to answer the af.d John Wildman of the af.d plea as to him it was Command And hereupon the said John Wildman Declared against the af.d Francis Porter in the plea af.d in form Following Somerset ss.t Francis Porter late of Somerset County planter was Attached to Answer unto John Wildman of a plea of trespass upon the Case &c And Whereupon the same John by William Arbuckle his Attorney Complains that whereas the said Francis the fourteenth day of August seventeen hundred and thirty eight at Somerset County af.d was Indebted to the same John in the sum of twenty Eight pounds Eleven shillings and one penny Current money of Maryland for Sundry Articles and things properly Chargeable in Acco.t as by ^an^ Acco.t thereof herewith into Court brought may appear and being so thereof indebted in Consideration thereof afterwards viz.t the day and year af.d at the County af.d the said Francis upon himself did assume and to the same John then and there faithfully promised that he the said Francis |
