82 as the aforesaid Moses Chaille above against him hath alledged and assessed the damages of the Same Moses by Occasion of the non performance of the promisse and assumption aforesaid beyound his Costs and Charges by him about his Suit in that part apposed to Two pounds Seventeen Shillings and Ten pence Cu in Gold and for those Costs and Charges to One pound of tobacco Therefore it is Considered that the af.d Moses Challie recover against the af.d Nathaniel Horsey his damages af.d to two pounds Seventeen shillings and ten pence in Gold by the Jurors af.d in form af.d Assessed as also Nine hundred and Twelve 890 Eleven pounds of tobacco for his Costs and Charges af.d to the same Moses of his request by the Court now here of his Assent af.d adjudged which Certain damages in the whole amounts to two pounds Seventeen and ten pence in Gold and Nine hundred and Twelve pounds of tobacco and the af.d Nathaniel in mercy &c
that he might have her body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of March Anno Dom one thousand seven hundred and thirty nine to Answer unto John Rousby Esq.r of a plea that she Render unto him fifty nine pounds sterling which from him she unjustly detains &.a and the same day is given to the afd John here &.a Att which day here Came the afd John Rousby Esq.r by George Douglas his attorney and the sheriffe to witt John Henry Gent now here Returned that he had taken the afd Mary Larrimore whose body hereat this day he had Ready to Answer the afd John Rousby of the afd plea as to him it was Commanded &c And the aforesaid Mary Larramore by ^William^ Arbuckle her attorney Comes and Saving to herselfe all and all manner of Advantages ^and Exceptions^ to the writt aforesaid prays Leave thereof to Imparle here untill next Court to be held at dividing Creek in and for the County aforesaid the third Tuesday of June then next following and she hath it and the same day is given to the aforesaid John Rousby here also &c Att which day here Came againe the parties afd by their attorneys afd and hereupon the said John Rousby declared against the afd Mary Larramore in the plea afd in form Following Somerset ss Mary Larramore late of Sommerset County widdow Executrix of the testament and ^last^ will of John Larramore late of Somerset County deceased otherwise lately Called John Larramore of Somerset County in the province of maryland planter was summoned to Answer unto John Rousby Esq.r of a plea that she render unto him fifty nine pounds sterling which from him she unjustly detains &.a And Whereupon the said John Rousby by George Douglas his attorney says that whereas the said John in his life to wit on the Eighteenth day of August MDVCCXXvix at the County afd by his Certain writing Obligatory which the said John Rousby sealed with the seal of the said John Larramore herein Court brings whose date is the day and year afd did acknowledge himself to be held and firmly bound unto the said |
