80 writing Obligatory which the same Alexander sealed with the proper seal of the afd Major hereunto Court brings whose date is the same day and year afd Acknowledged to himself to be held and firmly bound unto the said Alexander by the name of Alexander Buncle of the afd County Merchant in the said sum of fifty Pounds sterling money to be paid to the same Alexander when he should be thereto Required Nevertheless the afd Major the afd sum of fifty Pounds to the same Alexander hath not as yet paid but the same to pay hath hitherto altogether denyed and still doth deny to the damage of the same Alexander fifty Pounds sterling and thereof he brings suit &.a Pledges &.a J Doe & R Roe And the afd Major Hudson by William Arbuckle his attorny Cometh and defendeth the force and Injury when &.a and saith that he Cannot deny the action afd of the afd Alexander Buncle nor but that the writing Obligatory afd is the deed of the same Major Hudson nor bu that he oweth and the same Alexander the afd fifty pounds sterling money of Great Brittain in manner and form as the afd Alexander above against him hath declared Therefore it is Considered that the afd Alexander Buncle Recover against the afd Major Hudson his debt afd and his damages by Occasion of the detention of the same debt to 275 Pounds of tobacco to the same Alexander of his assent by the Court here adjudged and the afd Major in mercy &.a And Whereupon the same Alexander by George Douglas his attorney says that whereas the afd Jacob on the nineteenth day of June in the year of our Lord Seventeen hundred and forty at Somerset County afd by his Certain writing Obligatory which the same Alexander with the proper seals to be held and firmly bound unto the same Alexander by the name of Alexander Buncle Burck of the afd County Merchant in the said sum of thirty six Pounds to be paid to the same Alexander when he should be thereto Required Nevertheless the afd Jacob the afd sum of thirty six Pounds to the same Alexander nor any part thereof hath not as yet paid but the same to pay hath hetherto Altogether denyed and still doth deny to the damage of the same alexander thirty six pounds Currt money and thereof he brings suit &.a Pledges &.a J: Doe & R: Roe And the Jacob Hammond by William Arbuckle his attorny Cometh and defendeth the force and Injury when &.a and saith that he Cannot deny the Action afd of the afd Alexander Buncle nor but that the writing Obligatory afd is the deed of the same Jacob nor but that he oweth the same Alexander the afd |
