78 Therefore it Considered that the af.d Joseph Ennall Recover against the af.d John Evans his debt af.d and 297 his damages by Occasion of the detention of the same debt to Two hundred and Ninety Seven pounds of tobacco to the same Joseph of his Assent by the Court here Adjudged and the af.d John in mercy &a
the nineteenth day of March Ann Dom one thousand seven hundred and thirty Eight at Somerset County af.d within the Jur of this Court by his Certain writing obligatory which the said Joseph Ennalls with the seal of the said Joseph Records signed here into Court brings the date whereof is the same day and year did Acknowledge himself to be bound unto the af.d Joseph Ennalls in the af.d twenty pounds to be paid unto the said Joseph Ennalls when he should be thereto required yett the said Joseph Records tho' often required the said twenty pounds to the said Joseph Ennalls hath not rendred but the same to him hitherto to render hath denied and still doth deny and unjustly detain to the damage of the said Joseph Ennalls of Fifteen pounds Current money of Maryland and thereof he brings suit &a Pledg.s &c J: Doe R: Roe And the af.d Joseph Records by William Arbuckle his Attorney Cometh and defendeth the force and Injury when &c and saith that he Cannot deny the Action af.d of the af.d Joseph Ennalls nor but that the writing obligatory af.d is the deed of the same Joseph Records nor but that he oweth the same Joseph Ennalls the af.d twenty pounds Current money of Maryland in manner and form as the af.d Joseph Ennalls above against him hath declared Therefore it is Considered that the af.d Joseph Ennalls recover against the af.d Joseph Records his debt af.d and 237 his damages by Occasion of the detention of the same debt to Two hundred and ninety Seven pounds of tobacco to the same Joseph Ennalls of his Assent by the Court here Adjudged and the af.d Joseph in mercy &c
And Whereupon the said Joseph by Francis Allen his Attorney saith that whereas the said John the third day of November Anno Dom one thousand seven hundred and thirty and Eight at Somerset County af.d within the Jur of this Court by his Certain writing obligatory which the said Joseph with the seal of the said John Signed here into Court brings the date whereof is the same day and year did Acknowledge himself to be bound unto the af.d Joseph in the af.d two thousand four hundred pounds of tobacco to be paid unto the said Joseph when he should be thereunto required yett the said John tho' often required the said two thousand four hundred pounds of tobacco to the said Joseph hath not rendred but the same to him hitherto to render hath denied and still doth deny and unjustly detain to the damage of the said Joseph of |
