76 when &.a and saith that he Cannot deny the action afd of the afd Thomas Ennalls nor but that he did assume upon himself in manner and form as the afd Thomas Ennalls above against him hath Complained and as to the damage of the same Thomas by him by Occasion of the premisses in that part sustained the same Joseph Lewis saith and acknowledgeth that the afd Thomas hath sustained damages by Occasion of the Premisses beyond his Costs and Charges by him about his suit in that part apposed to Seven Pounds fourteen Shillings Currt money of maryland and not more and because the afd Thomas denys not this but the same Allegations grants to be true prays Judgment for those damages above acknowledged together with his Costs and Charges afd to him to be adjudged &.a Therefore ^by^ Consent of the parties afd It is Considered that the afd Thomas Ennalls Recover against the afd Joseph Lewis his damages afd to the afd Seven pounds fourteen Shillings Currt money of maryland 353 by the same Joseph in form afd acknowledged as also Pounds of tobacco for his Costs and Charges afd to the same Thomas at his Request by the Court now here of the Assent of the parties afd Adjudged which Certain damages in the whole amounts to Seven Pounds Fourteen Shillings Currt money of maryland and Pounds of tobacco and the af.d Joseph in mercy &.a
the same County the third Tuesday of March Anno Dom one thousand seven hundred and forty to answer unto Peter Taylor of a plea that he render unto him the sum of fifteen pounds which to him he owes and unjustly detains &c and the same day is given to the af.d Peter here &c And hereupon the said Peter Taylor declared against the af.d Heber Whittingham in the plea af.d in form Following Somerset ss.t Heber Whittingham late of Somerset County Inholder otherwise Called Heber Whittingham of the af.d County and province was Summoned to Answer Peter Taylor of a plea that he render unto him the sum of fifteen pounds which to him he owes and unjustly detains &.c And Whereupon the said Peter by Robert Jenckins Henry his Attorney says that whereas by Certain Articles of Agrement made at Somerset County af.d the twenty second day of December in the year of our Lord one thousand seven hundred thirty and nine between him the said Peter by the name of Peter Taylor of Somerset County in the province of Maryland of the one part and the af.d Heber Whittingham by the name of Heber Whittingham of the af.d County and province of the other part which said Articles of agrement with the seal of the af.d Heber Signed the same Peter here into Court doth bring the date of which is the same day and year af.d the af.d Heber in Consideration that the said Peter did thereby grant let and hire unto him the said Heber a Certain Negro woman named Fungo From the af.d Twenty second day of December in the year af.d untill the |
