76 that he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the same County the third Tuesday of March Anno Dom one thousand seven hundred and forty to answer unto Thomas Ennalls of transquakin of a plea of trespass upon the Case &c and the same day is given to the Thomas here &c And hereupon the said Thomas Ennalls declared against the af.d Joseph Lewis in the plea af.d in form Following Somerset County ss.t Joseph Lewis late of Somerset County planter was attached to answer unto Thomas Ennalls of a plea of trespass upon the Case &c And Whereupon the said Thomas by Francis Allen his Attorney Complains that whereas the said Joseph the twenty Eighth day of Nov.r Anno Dom Seventeen hundred and thirty six at the County of Somerset af.d within the Jur of this Court was Indebted unto the said Thomas in Seven POunds Fourteen Shillings Currt money of maryland it being the ballance of an account to the said Thomas by the said Joseph before that time due owing and unpaid and being so thereof Indebted the said Joseph in Consideration thereof the day and year afd at the County af.d upon himself did assume and to the said Thomas then and there did faithfully promise that he the said Joseph the said Seven Pounds fourteen Shillings to the said Thomas when he should be thereunto Requested he would well and faithfully Pay and Content Nevertheless the said Joseph his promise and assumption afd in forme afd made nothing Regarding but plotting and fraudulently Intending the said Thomas in that part Craftilly and Subtilly to deceive and defraud the said seven Pounds fourteen Shillings to the said Thomas tho' often by him thereunto Requested hath not paid but the same to him hitherto to Pay hath refused and still doth Refuse and deny to the damage of the said Thomas of teen pounds money afd and thereof he brings suit &a Pledges &.a J: Doe & R: Roe Att which day here Came the afd Thomas Ennalls by his attorney afd and the sheriffe to wit John Handy Gent now here Returned that he had taken the afd Joseph Lewis whose body hereat this day he had Ready to Answer the afd Thomas Ennalls of the afd plea as to him it was Commanded Whereupon Came hereinto Court a Certain John Purnall Jr of Somerset County planter in his proper person and undertook for the said Joseph Lewis (Likewise the said Joseph Lewis present herein Court in his proper person assumed upon himself) that if it should happen that Judgment in the plea afd should be Rendred for the same Thomas against him the said Joseph or that he the same Joseph should be therein Convict that then he the said Joseph should pay and Satisfie unto the said Thomas the Judgment of the Court thereupon or Render his body in Execution of such Judgment to the prison of the sheriffe of the County afd in satisfaction thereof or that he the same John Purnall will do the same for him &.a And the afd Joseph Lewis in his proper person Cometh and defendeth the force and Injury when &.a |
