73 Almighty God deposeth and saith that he was with John Tunstall of the County afd and at the house of Coll Kings in the afd County and as this deponant was Coming a Cross Glanvells Lott with the afd Tunstall and Severall others that the afd Tunstall shewed this deponant and the Rest of the Company a Line tree and told them it was one of Capells Kings Line trees and this deponant sence at the house of Capt Tunstalls was a talking about the Line trees that was marked between the afd Tunstall and the Land belonging now to M.r Robinson and Tunstall told this deponant that Mabe it was Capt Smith Marked them and further saith not Luis Rigsby Richard Chambers of Somerset County Aged about fifty three years being sworn on the holy Evangelist of all mighty God deposeth and saith that he has often heard that there was a Jury Called by Thomas Wilson Guardian to Capell King both of the County afd to Run a devision all Line between Thomas Wilson and Capt Smiths Land Called and this deponant further saith that he has often times seen a Ceader Post set up at the Ingin Landing marked the same Course as the Line trees Goes and this deponant further saith that on a Resurvey made by Capell King of the afd County he heard Capt Tunstall Call to the Surveyor and told him he went within the Old marked trees and shewed them to the Surveyor and this deponant further saith that he has heard a Certain Elick Hall of the County afd allways low them marked trees to be the devision and the Ceder Post Between him and Capell King and he b^e^lieved the Ceader post was set up by the Jury for to devide them and further saith not Richard Chambers Daniel Burgan of Somerset County aged about sixty years being sworn on the holy Evangelist of almighty God deposeth and saith that when he was a servant to Capt John Tunstall of the afd County that the afd Tunstall and John Polk of the afd County Run a Line a Cross the point from the Gut to the River about a Chanes Length above the Pine as Old Phebus swore to and this deponant was ordered by Capt Tunstalls Overseer to make a Cratch on the Line and the fence was made on the Line and further saith not his Daniel + Burgin mark William Turpin of Somerset County Aged about thirty four years deposeth and saith that Capell King of the County afd Gott David Wilson Surveyor of the afd County to Run a Line between him and Capt Tunstall of the afd County and the Line was Run and Capt Tunstall stood at a popler as is marked as a Line tree and said I will see whether ye a Line Run Right or no for this poplar is one of the Line trees and the surveyor Came Close along by the popler and further saith not Will.m Turpin The Severall depositions were taken on the Premisses after due notice given according |
