60 Contrary to the peace of the said Lord proprietary that now is his good rule and Government and against the form of the Act of Assembly in such Case thereof lately made and provided &c Thereupon it is Commanded the sheriffe of Somerset County that he should take the said John Coffin if he should be found in his bailywick and him should safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in and for the County af.d the third tuesday of March Anno Dom one thousand seven hundred and forty to answer unto his said Lordship of the Indictment af.d &c And now to witt the day and Year abovesaid at a Court then held at dividing Creek in and for the County afd before his Lordships Justices the aforesaid John Coffin by John Handy Sheriffe of the County aforesaid to the barr here Ledd in his proper person and being Instantly asked how he of the premisses afd above upon him Imposed would thereof acquitt himselfe saith that he is not thereof guilty and thereupon of good and Evill he puts himselfe upon the Country And Robert Jenckins Henry Gent his Lordships attorney who for his said Lordship in this behalfe prosecutes in Like manner Therefore Command is to the Sheriffe of the County aforesaid that he should Cause to Come here before the afd Justices Immediately Twelve &c and who neither &c to Recognize &c And the Jurors of that Same Jury by the afd Sheriffe to this Impannelled to witt Hutton Hill David Polk John Woolford Edward Rooke Thomas Pollitt George Tull Panthur Laws Littleton Townsend William Gray John White Richard Wallis and John Davis being Called Came who to say the truth of the premisses aforesaid being Elected Tryed and Sworn upon their Oath say that the aforesaid John Coffin is not Guilty of the Felony in the Indictment aforesaid above upon him Imposed in manner and form as the aforesaid John Coffin for himselfe above by pleading alledged Whereupon all and Singular the premisses being seen and by the Court here fully understood It is Considered by the Court here that the aforesaid John Coffin be quiet and goe thereof without day &a
Request of the afd John Eshen ^the^ aforesaid Recognizance hath been respited by the Court here from Court to Court untill this Court &c And now to witt this seventeenth day of March One thousand seven hundred and forty at a Court then held at dividing Creek before his Lordships Justices Came the afd William Monks in Custody of the Sheriffe of the County afd in whose Custody before that time for the Caus afd was Committed and by the Sheriffe Ledd to the Barr in his proper person And Thereupon the said William Monks and his Security are discharged from the Recognizance afd Whereupon the said William Monks is Ordered to Give Security for all fee or fees due by means of the Recognizance afd to any person or persons whatsoever but for want thereof the said William Monks is Committed into the Custody of the Sheriffe of the County afd there to remain &.c Afterwards in the Same Court Came a Certain Aaron Lynn in his proper person and undertook for the said William Monks for the payment of all fee or fees due by means of the Recognizance afd to any person or persons whatsoever &c |
