     Command was given to the sheriffe of Somerset County that he should take Michael Holland late
of Somerset County Mariner if he should be found in his bailywick and him should safe keep so that he might
have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the
third Tuesday of November Anno Dom one thousand seven hundred and forty to answer unto William Whittington Complained against the
af.d Michael Holland in the plea af.d in form following         Somerset County ss.t  Michael Holland late of Somerset County
planter was attached to answer ^unto^ William Whittington of a plea of trespass upon the Case

                      And Whereupon the said William by Francis Allen his Attorney Complains that whereas the said Michael the Eleventh
day of May Anno Dom Seventeen hundred and forty at Somerset County af.d within the Jur of this Court was Indebted unto the said
William in Four hundred twenty and nine pounds of tobacco for Sundrys properly chargeable in Acco.t as by Ac.t thereof here in
Court ready to be produced may appear and being so thereof Indebted the said Michael in Consideration thereof the day and
year af.d at the County af.d upon himself did Assume and to the said William then and there did faithfully promise that he
the said Michael the af.d Four hundred twenty and nine pounds of tobacco to the said William when he should be thereto
requested well and faithfully he would pay and Content  Nevertheless the said Michael his promise and Assumption af.d in
forme af.d made nothing regarding but plotting and fraudulently intending the said William in that part Craftily and
Subtilly to deceive and defraud the said Four hundred twenty and nine pounds of tobacco to the said William Altho' the same
to do the said Michael on the af.d Eleventh day of may in the year af.d and often afterwards at Somerset County af.d he was
thereunto requested hath not paid or Contented but the same to him hitherto to pay or Content hath refused and still doth refuse
and deny to the damage of the said William of Eight hundred pounds of tobacco and thereupon he brings Suit &c
