42 185 Damages by occasion of the detaining of the same debt to One hundred and eighty five pounds of tobacco to the same George of his Assent by the Court here adjudged and the af.d Samuel in Mercy &c
or any three or two of you to be our Commissioners to Examine Evidences on behalf of a Certain Robert Geddes of Somerset County Inholder in Relation to the bounds of a tract of Land Called Little Derry lying in the County af.d we therefore Require you or any three or two of you at some time and place as to you or any three or two of you shall seem Convenient you mete on the af.d Land Called Little Derry you first having taken your Oaths on the Holy Evangelist of almighty God According to Act of assembly in such case made and provided) and there Cause to Come before you or any three or two of you all such Evidences as shall be to you or any three or two of you nominated by the Complainant or deft if any and that you or any three or two of you Examine them upon their Corporall Oaths to be by you or any three or two of you Administred on the holy Evangelist of almighty God in the presence of the Complainant or deft if any touching the truth or Remembrance of their knowledge or any thing that may relate to the Cause af.d and that Reducing the severall depositions into writing you send the same together with this our Commission under your or any three or two of your hands and seals to us to our County Court of Somerset with all Convenient speed Wittness Robert King Gent Chief Justice of our said Court the Twenty Seventh day of November Anno Dom one thousand seven hundred and thirty nine And now to witt the third tuesday of November being the Eighteenth day of the same month Anno Dom one thousand seven hundred and forty before his Lordships Justices at dividing Creek in Court Judicially sitting Came John Scott and William Lane two of the Gentleman nominated in the above Commission and made Return thereof to the Court here endorsed with the deposition thereto annexed in form following Be it Remembred that on the 25.th day of January 1740 Came before me Capt John Scott and made Oath on the holy Evangelist of almighty God that he would execute the within Commission According to act of assembly to the best of his knowledge Sworn before me Jno Scott September y.e 23.d 1740 The deposition of George Tull of Somerset County Planter aged Sixty two years or there abouts being sworn on the holy Evangelist of Almighty God upon his said Oath deposeth |
