3 William Colbert his damages aforesaid to the aforesaid four pounds three shillings Curr.t money of Maryland by the same William 230 Colbert in form aforesaid acknowledged as also pounds of tobacco for his Costs and Charges aforesaid to the same William Whittington at his request by the Court now here of the assent of the parties aforesaid adjudged which Certain damages in the whole amounts to four pounds three shillings Current money of Maryland and pounds of tobacco and the aforesaid William Colbert in mercy &.c
And Whereupon the said Heber by Robert Jenckins Henry his attorney says that whereas the said Elizabeth on the xxiv day of may An Dom MDCCXXXvij at the County af.d by her Certain writing Obligatory which the said Heber sealed with the seal of the said Elizabeth herein Court brings whose date is the day and year af.d did acknowledge herself to be held and firmly bound to the said Heber in the said twelve pounds Currt money to be paid to the said Heber his Ex.rs Adm.rs &.a when afterwards thereof required and for the payment thereof did bind her self and heirs by the said writing Nevertheless the said Elizabeth the said twelve pounds to the said Heber hath not rendred but that doe hetherto hath denyed and still doth deny and unjustly detain altho thereto afterwards to witt the day and year and af.d at the County af.d and often since that time by the said Heber required Whereupon he says he is damnifyed fifteen pounds Current money af.d and thereof he brings suit &.a Pledges &.a J Doe & R Roe And the af.d Elizabeth Peacock by George Douglas her attorney Cometh and defendeth the force and Injury when &.a and saith that she Cannot deny the action af.d of the af.d Heber Whittingham nor but that the writing Obligatory af.d is the deed of the same Elizabeth nor but that she oweth the same Heber the af.d twelve pounds Currt money in manner and form as the af.d Heber above against her hath declared Therefore it is Considered that the af.d Heber Whittingham Recover against the af.d Elizabeth PEacock his debt af.d and his damages by Occasion of the detaining 197 the same debt to One hundred and Ninety Seven pounds of tobacco to the same Heber of his assent by the Court here adjudged and the af.d Elizabeth in mercy &.a |
