307 Intending the said James of his good name to deprive the possession of his Lands ^and^ tenements to loose Imprisonment of his body to Suffer and make fine to the Lord Proprietary on the day of in the Year of Our Lord one thousand Seven hundred and forty to John Miller Gent One of the Justices of the Right Honourable the Lord Proprietary for keeping of the peace in the County aforesaid assigned this false feigned and scandelous Complaint against the said James as the said David did make to witt that he the said James on the twenty fourth day of March One Thousand Seven hundred and thirty nine into a Certain Messuage in the County aforesaid in the parish of all hollows Called Powells Lott [of which Messuage the said David Complained he was then Seized in his demesne as of fee] without force did Enter and the said David thereof did disseize and so having therein Entered on the day and Year aforesaid at the County and parish aforesaid with Other Malefactors with force and armes and with a strong hand the possession of the said ^Messuage^ from the said David did detain and him of the said Messuage aforesaid did disseize Whereupon the aforesaid John Miller gave Command to the Sheriffe of Sommerset County to Cause to Come before him at Powells Lott aforesaid in the County and parish aforesaid on the Twelfth day of July then next to Come Twenty four good and Lawfull men of the Vicinage of Powells Lott aforesaid to Enquire upon their Oaths for our said Lord the King and the Lord Proprietary of and Concerning the aforesaid Complaint Twelve of which good and Lawfull men aforesaid being ^duely^ Impannelled and Sworne truely and dilegently to Enquire of and Concerning of the premisses before the said John Miller then Judicially Sitting by the false Swearing and procurement of the said David the Jurors afd the following false ^and^ Scandelous Inquisition did make and return (to witt) Inquisition taken for the Right Honourable the Lord Proprietary of the province of Maryland at Powells Lott in the parish of all hollows in the County of Sommerset on the 12 day of July Ann Dom One Thousand Seven hundred and forty before John Miller Gent one of the Right Hon.rble the said Lord Proprietary his Justices the peace for the said County to Conserve assigned by the Oath of Joseph Miller Samuel Hall John Robinson William Hazzard David Hazzerd Daniel Wharton Hinman Wharton Casar Godwin John Johnson John Marsey George Howard Martin Kennett and John Collins good and Lawfull men of the said County and Vicinage of Powells Lott aforesaid who say upon their Oaths that David Hudson Late of Sommerset County aforesaid planter was Lawfully and peaceably Seized in Demesne as of fee in One Messuage with the Appurtenances in the County aforesaid called Powells Lot and Continued his Peaceable possession Thereof untill the xxiv day of March Anno Dom MDccxxxix untill James Stephen Bredell late of All hallows Parish in the said County of Somerset Planter Into the said Messuage on on the day and year aforesaid at the County aforesaid peaceably and without force upon the said Powells Lot did Enter and him the said David of the said Messuage did Disseize and the said James So peaceably into the said Messuage having Entred afterward to wit on the said xxiv day of March Anno Dom MDccxxxix at the County aforesaid with Other Malefactors to the Jurors unknown with force and Arms and with a srong hand the Possession of the said Powells Lot from the said David Hudson did detain and him of the Messuage aforesaid did |
