       June Court                   1742                           306

Tuesday of August then next following and he hath it and the Same day is given to the aforesaid Mathew here also &c

                         Att which day here Came againe as well the aforesaid Mathew Kemp as the aforesaid William King
by their attorneys aforesaid  And whereupon the Same William King prays further Leave thereof to Imparle hereuntill
next Court to be held at dividing Creek the third Tuesday of November then next following and he hath it and
the Same day is given to the aforesaid ^Mathew^ William here also &a

                                  Att which day here Came againe as well the aforesaid Mathew Kemp as the aforesaid Will.m
King by their attorneys aforesaid  and Whereupon the said William prays further Leave thereof to Imparle here untill
next Court to be held at dividing Creek the third Tuesday of March then next following and he hath it and the same day
is given to the aforesaid ^Mathew^ William here also &a

                      Att which day here Came againe as well the aforesaid Mathew Kemp as the aforesaid William King
by their attorneys aforesaid and Whereupon as well the aforesaid Mathew as the aforesaid William submitted their dispute
in this action to the arbitrament and final determination of George Dashiel and Isaac Handy of Sommerset County
Gentlemen and it is agreed by and between the aforesaid Mathew and William that the aforesaid Arbitrators Return their arbitrament
from under their hands and Seals in writing to the next Court to be held at dividing Creek in and for the County aforesaid
agreeable to the arbitrament to be made by the arbitrators aforesaid as if the Cause were determined by the Court &a and further
it is agreed by and between the aforesaid mathew and William that that Submission aforesaid in manner and form aforesaid
made according to the force form and affect of the Statute in Such Case made and provided be Entered and made a rule of this
Court on the nootion of the parties aforesaid                     and the Same day is Given to the parties aforesaid here &a

                            Att which day to witt the third Tuesday of June before his Lordships Justices at dividing Creek Came as well
the aforesaid Mathew Kemp as the aforesaid William King by their attorneys aforesaid but the aforesaid arbitrators at the
Same day altho' Solemnly required Came not nor made not any arbitrament in the premisses aforesaid pursuant to the
aforesaid Submission &a
                                              Thereupon the aforesaid William King as before defends the force and Injury when &a and
saith that he did not assume upon himselfe in Such manner and form as the aforesaid Mathew Kemp above against
him hath Complained and of this he puts himselfe upon the Country and the aforesaid Mathew in Like manner

             Therefore it is Commanded ^the sheriffe that he should^ Cause to Come here Immediately before his Lordships Justices Twelve &.a by whom &a
and who neither &.a to Recognize &.a because as well &.a and the Jurors of that Same Jury by John Handy Gent sheriffe
of the County aforesaid to this Impannelled to witt John Dennis J.r William holland Isaac Brittingham Joshua Atkinson
James Houston Elijah Brittingham Christopher Glass James Townsend Micajah Brittingham Hinman Wharton
Levin Powell and George Hudson being Called Came who to Say the truth of the premisses being Elected tryed and Sworn
upon their Oath Say that the aforesaid William King did assume upon himselfe in manner and form as the aforesaid
Mathew Kemp above against him hath Complained and assessed the damages of the same Mathew by Occasion of the nonperformance
of the promise and assumption aforesaid ^beyond his Costs and Charges by him about his Suit in this part apposed^ to five pounds Eighteen Shillings and Six pence Currant money
