282 in relation to the bounds of a tract of Land or part of a tract Called Gethsemaine or any other on which the same depends We Therefore require you or any three or Two of you at some time and place as to you or any Three or Two you shall Seem Convenient you meet on the aforesaid Land Called Gethsemaine (Your first having taken your Oaths on the holy evangelist of Allmighty God According to Act of Assembly in such Case made and provided and there Cause to Come before you or any three or two of you all such evidences as shall be to you or any three or two of you nominated by the Complainant or deft if any and that you or any three or two of you examine them upon their Corporall Oaths to be by you or any three or two of you administred on the holy evengelist of Allmighty God in the presence of the Complainant or def.t if any touching the truth or Remembrance of their knowledge or any thing that may relate to the Cause af.d and that reducing the severall depositions into writing you send the send same together with this our Commission under your or any three or two of your hands and seals to us to our County Court of Somerset with all Convenient speed Wittness Robert King Gent Chief Justice of our said Court the twenty ninth day of November Anno Dom one thousand seven hundred and thirty nine And now to witt the third Tuesday of June being the fifteenth day of the same month Anno Dom one thousand seven hundred and forty two at a Court then held at dividing Creek before his Lordships Justices in and for the County of Somerset Came John Gale and Mathias Dashiell two of the Gentlemen nominated in the above Commission and made return thereof endorsed with the deposition thereto annexed in form Following John Gale and Mathias Dashiell Gent were qualified on the within Commission by me Geo Dashiell We the Subscribers being appointed Commissioners to Examine Evidences in Relation to the bounds of a tract of Land Called Gethsamane do hereby Certifie that we met on the said Land the 29th day of October 1741 and took the Following depositions the person being first sworn by us Given under our hands and seals this 11th day of June Anno Dom 1742 John Gale (seal) Mathias Dashiell (seal) M.r James Train aged sixty four being sworn on the holy Evangelist of Allmighty God saith that about fourteen ^or fifteen^ years agoe he was rideing along the road in Company with Mr Nutter and being in sight of a mulburrey post this deponant asked what was the meaning of that post standing there and he told him that it was the bounder of three tracts of Land and doth not remember what the names of the Land was but he understood him that one of the tracts of Land was Gethsemaine and one other of the tracts of lay to the Eastward and the other to the south ward of the said post and that not Long after that time the af.d post was removed |
