277 the fornication in the Indictment aforesaid said to be Committed therefore it is Considered that the Indictment aforesaid be quashed and that the said Benjamin Derixon Goe thereof without day &a and it is said by the Court here unto Robert Jenckins Henry Gentleman his Lordships attorney who for his said Lordship in this part prosecuteth that he Exhibitt to this Court an Information against the afd Benjamin Derixon for adultery &a
in the year of Our Lord one thousand seven hundred and forty two before Robert King Gent Esq.r and his Associates the said Lord proprietary his Justices of the same County Court and for the same Lord proprietary doth give the Court here to understand and be Informed that Shelah Doughen late of Stepney Parish in the said County of Somerset spinster the first day of April in the year of our Lord one thousand seven hundred and forty one at the parish af.d in the County af.d within the Jurisdiction of this Court did Commit fornication with a Certain person unknown and did permit the same unknown person to have Carnal knowledge of her body and of her body then and there to have Carnal knowledge of her body and to beget then and there a bastard Child on the body of her the same Shelah to the high displeasure of Allmighty God to the Evill Example of all others in such Case offending Contrary to the peace of the right Honrble the Lord proprietary that now is his Good rule and Government and against the form of the Act of Assembly in such Case lately made and provided &.c Whereupon the same Attorney of the same Lord proprietary for the same Lord proprietary prays advice of the Court herein the premisses and that due process of Law in this part against the same Shelah Doughen may be made to answer unto the same Lord proprietary of and upon the premisses &c Thereupon Command is to the sheriffe of the County af.d that he should Take the said Shelah Doughen if &a to answer &a And now to witt at that same Court held for the County af.d at dividing Creek this Fifteenth day of June Anno Dom one thousand seven hundred and forty two before the af.d Justices Came the af.d Shelah Doughen in her proper person According to a Certain recognizance by her and her Security in his part first Acknowledged and had a hearing of the Information af.d and saith that she Cannot deny but that she is guilty of the premisses af.d in the Information af.d specified above upon her Imposed in manner and form as by the Information af.d above upon her supposed &.a Whereupon all and Singular the premisses being seen and by the Court |
