257 the County aforesaid in Satisfaction thereof or that they the said Robert Lamberson or Robert Lindall will do the Same for him And the aforesaid John Lamberson by George Douglas his attorney aforesaid Comes and Saving ^to himself^ all manner of Advantages to the writt aforesaid prays Leave thereof to Imparle here untill next Court to be held at dividing Creek in and for the County aforesaid the third Tuesday of August then next following and he hath it and the Same day is given to the aforesaid Thomas Fletcher here also &a Att Which day here Came againe as well the aforesaid Thomas Fletcher as the aforesaid John Lamberson by their attorneys aforesaid And hereupon the said Thomas declared against the aforesaid John in the plea aforesaid in form following Sommerset County ss John Lamberson late of Somerset County planter al dict John Lamberson of the County of Somerset in the province of Maryland planter was summoned to answer unto Thomas Fletcher of a plea that he render unto him one hundred and forty pounds Curr.t money of Maryland which to him he owes and unjustly detains &c And Whereupon the said Thomas by Francis Allen his Attorney saith that whereas the said John the twenty second day of June Anno Dom Seventeen hundred and thirty nine at the County of Somerset af.d within the Jur of this Court by his Certain writing obligatory which the said Thomas with the seal of the af.d John signed hereinto Court brings the date whereof is the same day and year did acknowledge himself to be bound unto the said Thomas in the af.d one hundred and Forty pounds Curr.t money of Maryland to be paid to the said Thomas when he should be thereunto required yett the said John tho' often required but the said one hundred and forty pounds to the said Thomas hath not rendred but the same to him hitherto to render hath denyed and still doth deny and Unjustly detain Whereupon the said Thomas saith he is worse and hath damage to the value of Eight pounds money af.d And thereof he brings Suit &c Pledg.s &.c J Doe R Roe And whereupon the aforesaid John Lamberson by his attorney aforesaid Comes and defends the force and Injury when &.c and Saving to himselfe all and all manner of Exceptions and advantages as well to the writt as the declaration aforesaid prays Leave thereof to Imparle here untill next Court to be held at dividing Creek in and for the County aforesaid the third Tuesday of November then next following and he hath it and the Same day is given to the afd Thomas here also &c Att which day here Came again as well the aforesaid Thomas Fletcher as the aforesaid John Lamberson by their attorneys aforesaid and whereupon the said John as before defends the force and Injury when &a and prays an hearing of the writing obligatory af.d and he hath it he prays also hearing of the Condition of the writing obligatory af.d and it is read to him in these words The Condition of the above obligation is such if the above bounden John Lamberson his heirs Executors adm.rs or assigns shall and doe well and truly for his or their parts alienate Convey and make over by Generall Warrantee a good sure perfect and Indefeasible estate of by fee simple of in and unto two hundred acres of Land Lying on the south side of pocomoke river in the County af.d Called and known by |
