     Command was given to the Sheriffe of Sommerset County that he
Should Take Samuel MccClester Late of Sommerset County planter Otherwise
Called Samuel Macclester of Sommerset County if he Should be found in his bailywick
and him should safe keep so that he might have his body before the Justices of his Lordships County
Court of Somerset to be held at dividing Creek the third Tuesday of March Anno Dom one thousand seven
hundred and forty one to answer unto Charles Carroll of a plea that he render unto him the sum of twenty
Eight pounds fifteen shillings Curr.t money which to him he owes and unjustly detains &c  and the same day
is given to the af.d Charles here &c

                And hereupon the said Charles Carroll declared ^against^ of the af.d Samuel MaClester in the plea af.d in form
Following   Somerset ss.t  Samuel MccClester late of Somerset County planter otherwise Called Samuel
Macclester of Somerset County was summoned to answer unto Charles Carroll of a plea that he render unto
him the sum of twenty Eight pounds fifteen shillings Curr.t money which to him he owes and unjustly
detains &c
                         And Whereupon the same Charles by Robert Jenckins Henry his Attorney says that
Whereas the af.d Samuel the twenty third day of July in the year of our Lord one thousand seven hundred
and forty at Somerset County by his Certain Writing obligatory did grant himself to be held and firmly
bound to the said Chatles in the af.d sum of twenty Eight pounds fifteen shillings Curr.t money to be paid
to the af.d Charles when thereof he should be requested  Nevertheless the said Samuel altho often requested
the af.d twenty Eight pounds and fifteen shillings unto the same Charles he hath not rendred but the same
to him hetherto to render hath refused and still doth refuse    Whereupon he says he is the worse and hath
Damage to the value of twenty pounds Curr.t money of Maryland and thereof he brings suit &c  And brings
hereinto Court the writing af.d which the debt af.d in form af.d doth testify the date of which is the same day
and year af.d &c                                                                                             Pledg.s &c  J Doe  R Roe

             A Copy of the foregoing declaration was made and sent to be served on the defendant in order for
a speedy tryall     
                                     Att which day here Came the af.d Charles Carroll by Rob his Attorney af.d and the
sheriffe to witt John Handy Gent now here returned that he had taken the af.d Samuel MccClester whose
body here at this day he had ready to answer the af.d Charles Carroll of the af.d plea as to him it was Commanded

                      And the af.d Samuel MccClester in his proper person Comes and defends the force and Injury when
&c and saith that he Cannot deny the Action af.d of the af.d Charles Carroll nor Can he say but that
the bill ^writing^ obligatory af.d is his deed nor but that he owes the same Charles Carroll the af.d twenty Eight
