250 Hopkins for your so doing this shall be your Warrant Given under my hand this 9th of Febry 1741/2 To M.r Thomas Hayward Clk Somerset County Jam.s Martin Pursuant to the abovesaid warrent and according to act of Assembly in Such Case made and provided was Issued the following attachment against the goods and Chattles Rights and Credits of the aforesaid Daniel Harick Sommerset ss Charles Absolute Lord and proprietary of the provinces of Maryland and Avalon Lord Baron of Baltemore &c To the sheriffe of Somerset County Greeting we Command you that you attach any the goods Chattles Rights or Credits of Daniel Harrick late of Somerset County planter if they shall be found in your bailywick to the value of one hundred twenty four pounds four shillings and four pence Curr.t money of Maryland and seventeen hundred pounds of tobacco and when you have the same attached or ay part thereof the sam in your Custody safe keep so that you have the same before our Justices of our County Court of Somerset to be held at dividing Creek the third tuesday of March next then and there to be Condemned According to Act of Assembly to and for the use of a Certain Samuell Hopkins Jun.r unless the said Daniel Harrick by himself or his Attorney shall appear and answer unto the said Samuel Hopkins of a plea that he render unto him one hundred and twenty four pounds four shillings and four pence Curr.t money of Maryland which to him he owes and unjustly detains &c According to Law and that by good and Lawfull men of your bailywick you make known unto the person or persons in whose hands ought not to be Condemned and Execution thereof had and made (According to Act of Assembly in such Case made and provided) if to him her or them it shall seem meet and how you shall Execute this ^writt^ that you make known unto our said Justices at the day and place af.d and have you then and there this Writt Wittness John Scott Gent one of our Justices of our said Court the twenty Sixth day of November Anno Dom one thousand seven hundred and forty one Att which day here Came the af.d Samuel Hopkins in his proper person and the sheriffe to witt John Handy now here made return of the foregoing Writt to the Court here endorsed in these words Following I hereby Certifie that by Virtue of the within writ to me directed on the Sixtheenth day of March in the year of our Lord one thousand seven hundred and forty one within my bailywick I Attached of the goods Chattles rights and Credits of Daniel Harrick within to the value of thirty three pounds twelve shillings and three pence Curr.t money of maryland in part of the within sum of one hundred and twenty four pounds four shillings and four pence and seventeen hundred pounds of tobacco as by a shedule thereof hereto annexed may appear which I have ready to be Condemned to and for the use of the within named Samuell Hopkins as by the within Writt I am Commanded I do hereby further Certifie |
