forty one to answer unto William Whittington of a plea that he render unto him four pounds five shillings and one penny sterling money and two hundred and thirty pounds of tobacco which to him he owes and unjustly detains &c and the same day is given to the af.d William here &c And hereupon the said William Whittington declared against the af.d Edward Rownd in the plea af.d in form Following Somerset ss.t Edward Rownd late of Somerset County Inholder was summoned to answer to unto William Whittington of a plea that he render unto him four pounds five shillings and one penny sterling money and two hundred and thirty pounds of tobacco which to him he owes and unjustly detains &c And Whereupon the said William by Francis Allen his Attorney Complains that whereas the af.d William at a County Court of the right Honrble the Lord propry of this province held at dividing Creek in the County of Somerset ^in and for the County of Sommerset^ the third Tuesday of August Anno Dom seventeen hundred and forty before Robert King Gent and his Associates Justices of the said Court by the Consideration of the said Court recovered against the af.d Edward by the name of Edward Rownd late of Somerset County Gent the af.d sum of four pounds five shillings and one penny sterling money and two hundred and thirty pounds of tobacco as by the record and proceding thereof in the said County Court of the right Honourable the Lord propry of this province here at at Somerset County af.d remaining more fully and plainly appears is manifest by which said Judgment as yett remains in full force strength and effect altogether unreversed and is annulled or vacated or satisfied and the said William hath not as yett ^Sued Out^ Execution upon the Judgment af.d by which Accon accrues to the said William to have and require of the af.d Edward the af.d four pounds five shillings and one penny sterling and two hundred and thirty pounds of tobacco Nevertheless the af.d Edward tho' often required the af.d four pounds five shillings and one penny Sterling and two hundred and thirty pounds of tobacco to the said William as yett hath not rendred but the same to him hitherto to render hath denyed and still doth deny and unjustly detain Whereupon he saith he is worse and hath Damage to the value of Eight pounds ten shillings Like money and five hundred pounds of tobacco and thereupon he brings suit &c Pledg.s &.c J Doe & R Roe A Copy of the foregoing declaratin was made and sent to be served on the defendant in order for a speedy tryall Att which day here Came the af.d William Whittington by his Attorney af.d and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Edward Rownd whose body hereat this day he had ready to answer the af.d William Whittington of the af.d plea as [illegible] Commanded and further the said sheriffe returned that he had served the af.d Edward Rownd with a Copy of the foregoing declaration According to Act of Assembly in |
