248 Our ^Lord one^ Thousand Seven hundred and five to witt the Twenty fourth day of November in the Year of Our Lord One thousand Seven hundred and forty One at Somerset County did make his Certain note in writing Called a promisory note with his proper hand thereto Subscribed bearing date the Same day and Year Last above mentioned which said note the aforesaid Solomon to the aforesaid Robert Geddes then and there did deliver and by the same note did promise to pay unto the said Robert Geddes or his Order within one month next after the date of the said note the quantity of four hundred and fifty pounds of good fat Merchantable Pork and in Case of default in the payment of the said Pork the Said Solomon by the same note did Oblige himself to pay unto the said Rob.t Geddes for the Pork the full price in money as it should rule in the markett for Such Comodityty when the same should become due and payable by reason of Which premisses as also by Vertue of the Statute in such Case thereof Lately made and provided the aforesaid Solomon became Chargeable to pay unto the same Robert Geddes or his Order the aforesaid quantityty of four hundred and fifty pounds of Pork within One month next after the date of the said note and in default of Such payment to pay unto the said Robert Geddes or his order for the said Pork in money the full markett price that in the markett should rule for Such Comoditys when the Same should become due and payable according to the Tenor of the note aforesaid and the aforesaid Solomon ^so thereof^ Chargeable being in consideration thereof afterwards to witt the same day and Year Last abovementioned at the County af.d upon himself did Assume and to the same Robert Geddes then and there faithfully promise that he the af.d Solomon the af.d Four pounds hundred and fifty pounds of pork within the time in the said note specified and in default the full market price thereof in money unto the same Robert Geddess agreable to the tenor of the note af.d he would well and faithfully pay and Content and the same Robert Geddes in fact saith that the market price of good fat merchantable pork at the expiration of one month next after the date of the same note and for which the such Commodity was sold (to witt) the twenty fifth day of December in the year of last mentioned at Somerset County af.d was at the rate of twenty and five shillings Curr.t money of Maryland by the hundred pounds weight and the same Robert Geddess further in fact saith that the ^said^ Solomon hath not paid unto him the said Four hundred and fifty pounds of pork or any pound thereof or him for the same in any sort Contented by means whereof Action hath accrued unto him the said Robert Geddess to demand and have of the af.d Solomon for the said four hundred and fifty pounds of Pork at the rate of twenty and five shillings Curr.t money af.d by the hundred pounds weight which in the whole amounts to five pounds twelve shillings and Six pence Nevertheless the af.d Solomon his promise and assumption af.d in form af.d made little regarding but minding and fraudulently intending the same Robert Geddes in that part Craftily and Suttlely to deceive and defraud the said sum of five pounds twelve shillings and six pence unto the same Robert Geddes or any penny thereof altho' the same to do the said Solomon afterwards (to witt) the twentyeth Day of Janry in the year last above mentioned and often since that time at Somerset County af.d by the same Robert Geddes requested hath not paid or him for the same in any sort Contented but the same to him to pay or Content the af.d Solomon hetherto hath refused and still doth refuse Whereupon the same Robert Geddes says he is the worse and hath damage to the Value of ten pounds Curr.t money of Maryland & thereof he brings Suit &c Pledg.s &c J Doe & R Roe A |
