appear before the Justices within mentioned at the day and place within Contained to shew Cause &a as by the within Writt

                And Whereupon the aforesaid John Horsey Garnishee of the afd Israel Holland and Ester his wife admrx
of the aforesaid John Harristoy dec.d in his proper person Comes and Saith that he Cannot gainsay but that he has of the
of the Rights and Creditts of the aforesaid John Harristoy to the Value of three Thousand pounds of tobacco nor Can he
say but that the Same Ought to be Condemned in his hands for the Use of the said Francis Allen as the Rights and Credits
of the said John Harristoy which the said Francis Allen doth not gainsay

                            Whereupon the aforesaid Francis Allen prays that upon his giving Security according to act
of assembly in Such Case made and provided the afd Sum of Three thousand pounds of tobacco so as aforesaid
acknowledged by the aforesaid John Horsey Garnishe as afd as of the Rights and Credits of the aforesaid John Harristoy
may be Condemned in the hands of the said John Horsey towards Satisfying unto the said Francis Allen the sum
of Two Thousand One hundred and Ninety One pounds of tobacco his damages as all Costs and Charges accrewing by means of
the writt of attachmt afd &a         Thereupon a Certain George Douglas of Sommerset County Gentleman present
herein Court in his proper person undertook for the said Francis Allen according to act of assembly that In Case the
afd Israel Holland and Esther his wife admrx of the aforesaid John Harristoy dec.d do at any time within a year and a day
appear and make all or any part of the said Francis Allens Claim against them Appear to be Satisfied or Otherwise
to be undue before the Laying of this attachment that then the said Francis Allen shall make restitution unto them the
said Israel Holland and Esther his wife admrx as afd of all or Such part thereof as shall be so made appear to be undue
&.a or that he the said George Douglas will do the same for him &a

               Therefore it is Considered that the aforesaid sum of three thousand pounds of tobacco the
sum so as aforesaid attached and acknowledged by the aforesaid John Horsey be Condemned in the hands of
the aforesaid John Horsey as of the Rights and Credits of the said John Harristoy dec.d towards Satisfying
unto the aforesaid Francis Allen as well the Sum of Two thousand One hundred and ninety one pounds of tobo
his damages afd as all Costs and Charges accrewing by means of the attachment afd and that the afd Francis Allen
have thereof his Execution against the afd John Horsey according to act of assembly &c      memorandm the plantiffe

Heber Whittingham late of Somerset County Inholder if he should be found in his bailywick
and him ^should^ safe keep so that he might ^have^ his body before the Justices of his Lordships
County Court of Somerset to be held at dividing Creek the third Tuesday of March Anno Dom one thousand
seven hundred and forty one to answer unto William Elligood of a plea that he render him thirty Eight pounds Curr.t
