 His Lordship the Right Honourable the Lord proprietary of the province
of Maryland Commanded the Sheriffe of Sommerset County by his writt in these
words Following      Sommerset ss    Charles absolute Lord and proprietary of
the provinces of Maryland and Avalon Lord Baron of Baltemore &c  To the
sheriffe of Somerset County Greeting we Command you that your attach any the
Chattles right or Credits of John Harristoy late of Somerset County Surgeon deceased if they shall be
found in your bailywick to the Value of three thousand pounds of tobacco and when you have the same
Attached or any part thereof the same in your Custody safe keep so that you have the same before our Justices
of our County Court of Somerset to be held at dividing Creek the third Tuesday of March Next then and
there to be Condemned According to act of Assembly to and for the use of a Certain Francis Allen Unless a Certain
Israel Holland late of Somerset County Marriner and Esther his wife admrx of the goods Chattles and Credits
which were of the af.d John Haristoy late of Somerset ^County^ Surgeon deceased by themselves or their attorney shall
appear and answer unto the said Francis Allen in a plea of trespass upon the Case &c  According to Law
and that by Good and lawfull men of your bailywick you make known unto the person or persons in whose
hands you make the same attachment that he she or they be and appear before our Justices of our County
Court to be held as af.d to shew Cause if any he she or they have ^why^ the same Goods Chattles rights or Credits so attached
in his her or their hands ought not to be Condemned and Execution thereof hd and ^made^ According to Act of
Assembly in such Case made and provided) if to him her or them it shall seem meet and how shall Execute
this writt that you make known unto our said Justices at the day and place af.d and have you then and there
this writt Wittness John Scott Gent one of our Justices of our said Court the twenty Sixth day of November
Anno Dom one thousand seven hundred and forty one

             Att which day here Came the aforesaid Francis Allen by George Douglas his attorney and the Sher
to witt John Handy Gent now here made Return of the foregoing writt to the Court here Endorsed
in these words Following   Sommerset ss  I do hereby ^humbly^ Certifie to the Justices within Mentioned that
by Virtue of the within Writt to me directed on the first day of march in the Year of Our Lord
One thousand Seven hundred and forty One within my bailywick I have attached of the goods
and Chattles Rights and Credits of John Harristoy within named to the Value of three thousand pounds
of tobacco in the hands of Nathaniel Horsey and John Horsey severally to be Condemned according
to act of assembly in Such Case made to and for the Use of Francis Allen within Named and I
do further Certifie that by Joshua Merrill and John Doe good and Lawfull men of my Bailywick
I have made Known unto the said Nathaniel Horsey and John Horsey Severally to be and
