    November Court                            1741                220

by their Attorneys af.d and hereupon the said Sarah Staples prays Leave thereof to
Imparle here untill next Court to be held at dividing Creek in and for the County af.d the
third tuesday of November then next Following and she hath it and the same day is given to
the af.d John here also &.a

                            Att which day here Came againe as well the af.d John Woolford as the af.d
Sarah Staples by their attorney af.d and hereupon the said John Woolford prays that the af.d
Sarah Staples to his decleration af.d may answer but the said Sarah at the same day altho'
Solemnly Called Came not nor nothing thereof saith in ban or preclusion of the action af.d
of the af.d John by which the same John Remaineth thereof against him undefended &a
for which Reason the af.d John his damages against the af.d Sarah ought to Recover
but because it is not known unto his Lordships Justices here what damages the af.d John
hath Sustained by occasion of the non performance of the promise and assumption af.d
in this part sustained           Therefore Command is to the sheriffe of the County af.d that
by the oath of honnest and Lawfull men of his bailywick he deligently Inquire what
damages the af.d John Dennis has sustained as well by occasion of the non performance
of the promise and assumption af.d as for his Costs and Charges by him about his suit in that
part expended and the Inquisition which thereupon he takes to his Lordships Justices at
the next Court to be held at dividing Creek the third tuesday of March then next Following
under his seal and ^the^ seals of them by whose oath he takes that same Inquisition he send together
with the writt thereof to him directed and the same day is given to the af.d John there &.a

     Command was given to the sheriffe of Somerset County that he should take Samuel
Love late of Somerset County Merchant if he should be found in his bailywick and him
should safe keep so that he might have his body before the Justices of ^His Lordships^ our County Court of
Somerset to be held at dividing Creek the third Tuesday of June Anno Dom one thousand seven hundred and forty one
to Answer unto Duncan Murray of a plea of trespass upon the Case &c  And the same day is given to the af.d Duncan here &a

                      Att which  day here Came the af.d Duncan Murray by George Douglas his Attorney and the sheriffe to witt John
Handy Gent now here returned that he had taken the af.d Samuel Love whose body hereat this day he wheady to answer
the af.d Duncan Murray of the af.d plea as to him it was Commanded

          And the af.d Samuel Love present herein Court in his proper person at the prayer of the af.d Duncan Murray is
