203 tuesday of August then next Following and ^they^ hath it and the same day is given to the af.d Ambross and Ruth here also &c Att which day here Came again as well the af.d Ambrose Willet and Ruth his wife as the af.d Peter and Shadrach Claywells by their Attorneys af.d and whereupon the said Peter and Shadrach Claywell prays further Leave thereof to Imparle hereuntill next Court to be held at dividing Creek in and for the County af.d the third Tuesday of November the next Following and they have it and the same day is given to the af.d Ambrose and Ruth here also &c Att which day here Came again as well the af.d Ambrose Willet and Ruth his wife as the af.d Peter and Shadrach Claywell by their Attorneys af.d and whereupon the said Peter and Shadrach Claywell as before defend the force and Injury when &c And say that they are not nor either of them is Guilty of the premisses above upon them Imposed as the af.d Ambross Willet and Ruth his wife above against him have Complained and of this they put themselves upon the Country And the af.d Ambross and Ruth in like manner Therefore it is Commanded the sheriffe that Immediately he should Cause to Come here before his Lordships Justices Twelve &c by whom &c and who nither &c to recognize &c because as well &c and the Jurors of that Jury being Called some of them to witt John Dennis J.r John Woolford Ephraim Waggaman George Tull William Nelson James Polk Moses Mills & William Gray Came and were Sworn upon that Jury and because the resid^u^e of the Jurors of that same Jury did not appear therefore others of those standing by hereunto allected by the sheriffe of the County af.d and at the request of the af.d Ambrose Willet & Ruth his wife and by the Command of the af.d Justices are newly put on whose names to the pannell within written are affiled according to the form of the statute in such Case made and provided which said Jurors so newly put on to witt David Polk Absolum Hobbs Samuel Powell ^and^ Benjamin Langford being Called Likewise Came who to say the truth of the premisses af.d together with the other Jurors af.d first Impannelled and Sworn being Ellected tryed and Sworn and of their Verdict thereupon by the Court were Charged and between themselves to Commune from the barr here did Recede and afterwards the same Jurors thereof between themselves agreed to their Verdict of and upon the premisses af.d to render to the barr here returned upon which the af.d Ambrose Willet and Ruth his wife altho' Solemnly Called Cometh not nor is their writt af.d against the said Peter & Shadrach Claywells further prosecuted Therefore it is Considered that the af.d Ambrose Willet and Ruth his wife and their pledges of prosecuting to witt John Doe and Richard Roe are in mercy and that the af.d Peter and Shadrach Claywell goe thereof without day &c Also it is Considered that the af.d Peter and Shadrach Claywell recover against the af.d Ambrose Willet and Ruth his wife 374 pounds of tobacco for their Costs and Charges by them about their defence in that part Sustained to the same Peter and Shadrach by the Court ^here^ of their Assent Adjudged According to the form |
