any of their heirs Ex.rs Adm.rs as shall and do well and truely pay or Cause to be paid unto the above said Orphans the ^afd^ sum of One
hundred and twenty two pounds ^two shillings and^ one farthing Curr.t money in Equal parts and portions According to Act of Assembly when they
shall arrive at full age to receive the same &c then the above obligation to be void and of none effect otherwise to remain in full

Command was given to the sheriffe of Somerset County that he should take the said James Townsend
late of Somerset County planter if he should be found in his bailywick and him should safe keep so
that he might have his body before the Justices of his Lordships County Court of Somerset to be held
at dividing Creek the third Tuesday of November Anno Dom one thousand seven hundred and forty to Answer unto Levin
Gale Esq.r of a plea of trespass upon the Case &c  And the same day is given to the af.d Levin here &c

                      Att which day here Came the af.d Levin Gale by George Douglas his Attorney and the sheriffe to witt John
Handy Gent now here returned that he had taken the af.d James Townsend whose body hereat this day he had ready to answer
the af.d Levin Gale of the af.d plea as to him it was Commanded

                Whereupon the af.d James Townsend puts in his place William Arbuckle Gent attorney at Law against the
af.d Levin Gale Esq.r of the af.d plea

                And thereupon at the request of the parties af.d day is to them now here given untill next Court to be held at dividing
Creek in and for the County af.d the third Tuesday of March then next following in the same state as at present saveing to the
parties af.d &c
                               Att which day here Came again as well the af.d Levin Gale as the af.d James Townsend by their Attorneys
af.d and hereupon the said Levin Gale Complained against the af.d James Townsend in the plea af.d in form Following
Somerset ss  James Townsend late of Somerset County planter was Attached to Answer unto Levin Gale Esq,r of a plea of trespass
upon the Case &c
                                  And Whereupon the same Levin by Geo Douglas his Attorney Complains that whereas the said
James on the first day of may Anno Dom Seventeen hundred thirty and eight at the County af.d was Indebted to the said
Levin in the Sum of two thousand one hundred and one pounds of tobacco for the like quantity of tobacco by the said Levin
for the said James at the Especiall request and instance of the said James to a Certain Joseph MccClester before that time paid
and so being thereof Indebted afterwards to witt the day and year af.d at the County af.d on Consideration thereof upon himself
did Assume and to the said Levin then and there faithfully promise that he the said James the said quantity of tobacco to the
said Levin when he should afterwards be thereto required would faithfully pay and Content  And whereas the said James
the same to wit the day and year af.d at the County af.d was Indebted to the said Levin in other two thousand one hundred
