       August Court                       1740                        19

pay and Content  Nevertheless the said Hugh his promise and assumption af.d Little regarding
but minding and fraudulently Intending the same John in this part Craftily and Suttlely
to deceive and defraud the af.d twelve pounds and ten Shillings or any penny thereof unto the
said John he hath not paid or in any sort ^for the same hetherto^ Contented altho the same to do the said Hugh
afterwards to witt the first day of may in the year of our Lord Seventeen hundred and forty
and often since that time at Somerset County af.d by him the said John was requested  Whereupon
the same John says he is worse and hath damage to the value of twenty and five pounds Currt
money of maryland and thereof he brings suit &.a

    And the af.d Hugh Brooks in his owne proper person Cometh and defendeth the force and
    Injury when &.a and saith that he Cannot deny the Action af.d of the af.d John nor Can he
say but that he did assume upon himself in manner and form as the af.d John Chalivers above
against him hath Complained and as to the damage of the same John by him by Occasion of
the premisses in that part sustained the said Hugh saith and acknowledgeth that the af.d John
hath sustained damages by Occasion of the premisses beyond his Costs and Charges by him about
his suit in that part apposed to twelve pounds ten Shillings Currt money and not more because
the af.d John denys not this but the same allegation grants to be true prays Judgment for those
damages above acknowledged together with his Costs and Charges to him to be adjudged &.a

       Therefore by Consent of the parties af.d It is Considered that the af.d John Chalivers
       Recover against the af.d Hugh Brooks his damages af.d to the af.d twelve pounds and ten
226   shillings Currt money ^in form aforesaid Acknowledged^ a also                           pounds of
       tobacco for his Costs and Charges af.d to the same John Chalivers at his request by the Court now here
       of the assent of the parties af.d Adjudged which Certain damages in the Whole amounts to twelve
       pounds and ten Shilling Currt money and                                                                     pounds of
       tobacco and the af.d Hugh in mercy &.a
