181 Court of Sommerset to be held at dividing Creek the third Tuesday of November Ann Dom One thousand Seven hundred and forty One to answer unto John Scarbrough of a plea of trespass upon the Cae &a and the same day is given to the aforesaid John here &a And the said John Scarbrough Complained of the aforesaid Adam in the plea aforesaid in form following Sommerset ss Adam Brafford late of Sommerset County Taylor was attached to answer unto John Scarbrough of a plea of trespass upon the Case &a And Whereupon the same John by George Douglas his attorney Complains that whereas the said Adam on the first day of January Anno Dom MDCCXXXiX at the County aforesaid was Indebted to the said John in the Quantity of nine hundred Eighty and three pounds of tobacco for the Like quantity of tobacco by the said John for the said Adam at the especiall Request and Instance of the said Adam before that time paid and so being thereof Indebted on Consideration thereof afterwards to witt on the day and year af.d at the County af.d upon himself did assume and to the said John Scarbrough then and there faithfully promise that he the said Adam the said nine hundred eighty and three pounds of tobacco to the said John Scarbrough when he should afterwards be thereto Required he would faithfully pay and Content And Whereas the said Adam Afterwards to wit the day and year af.d at the County af.d was Indebted to the said John Scarbrough in the further sum of four Shillings and nine pence Currt money of Maryland for nineteen pounds of Salted pork by the said John Scarbrough to the said Adam at the Especiall Request and Instance of the said Adam before that time sold and and delivered ^and also^ in the other and further Quantity of one hundred and fifteen pounds of tobacco for the like quantity of tobacco by the said John Scarbrough for the said Adam at the Especiall Request and Instance of the said Adam to a Certain Joseph M.ccClester before that time paid and so being thereof Indebted afterwards to witt the same day and year ^last^ af.d at the County af.d on Consideration thereof upon himself did assume and to the said John Scarborough then and there faithfully promise to pay that he the said Adam the said four shillings and nine Pence and one hundred and fifteen pounds of tobacco to the said John Scarbrough when he should be Afterwards thereto Required he would well and faithfully pay and Content Nevertheless the said Adam his Severall promises and assumptions af.d in form af.d made not Regarding but minding and fraudulently Intending the said John Scarbrough in that part Craftilly and Subtilly to deceive and defraud the said Nine hundred and Eighty three pounds of tobacco and one hundred and fifteen pounds of tobacco and four Shillings and nine pence to the said John Scarbrough hath not paid or him for the same in any sort hitherto to Contented but that to doe altogether hath Refused and still doth refuse altho' thereto afterwards to witt the day and year last af.d at the County af.d and often since that time by the said John Scarbrough required Whereupon the said John Scarbrough says he is damnifyed twenty six pounds Currt money of maryland and thereof he brings suit &.a Pledges &.a J: Doe and R Roe |
