Somerset County Judicial Records, 1740-1742


	August Court 1741 160 Att which day here Came againe as well the af.^d Francis Allen as the af.^d Peter Taylor by their attorneys af.^d And Whereupon the said Peter Taylor as before defends the force and Injury when &.^a and says that the said Francis his accon af.^d thereof against him to have and maintain ought not because he says that at the time when the English words in the decleration mentioned were supposed to be spoken and published he the said Peter did speak and Relate of the said Francis these english words Following if he (speaking of the said Francis) hath Charged John Evans the same Fee ^that^ he hath Charged me he hath taken double Fees without that that the said Peter Spoke and published of the said Francis the af.^d English words in the decleration of the said Francis above specifyed to witt Frank Allen hath taken double fees one from John Evans another from me in one and the same Cause as the said Francis by his decleration af.^d above supposes and this he is ready to Verify wherefore he prays Judgment if the said Francis his accon af.^d against him to have ought &.^a And hereupon the said Francis Allen prays Leave thereof to Imparle here untill next Court to be held at dividing Creek in and for the County af.^d the third tuesday of August then next Following and he hath it and the same day is given to the af.^d Peter Taylor here also &.^a Att which day here Came againe as well the af.^d Francis Allen as the af.^d Peter Taylor ^by their attorneys afd^ And Whereupon the said Peter Taylor Relinquesheth his Verification ^afd^ by him above alledged and saith that he Cannot deny the action af.^d of the af.^d Francis Allen nor Can he say but that he the said Peter spoak the words of the af.^d Francis in the decleration af.^d mentioned nor Can he say but that the said Francis ought to Recover ^his^ damages by occasion of the speaking and uttering of the words af.^d beyond his Costs and Charges by him about his suit in this part expended to twenty pounds Currt money of maryland and not more and because the af.^d Francis denys not this but the same allegations grant to be true prays Judgment for those damages af.^d above acknowledged together with his Costs and Charges af.^d to him to be adjudged Whereupon the af.^d Francis Allen freely herein Court Remitteth unto the af.^d Peter the af.^d Twenty pounds Currt money of maryland the damages af.^d by the af.^d Peter in form af.^d acknowledged therefore the same Peter of the af.^d Twenty pounds be thereof quiet &.^c Therefore it is Considered that the af.^d Francis Allen Recover against the af.^d Peter Taylor the af.^d Twenty Pounds Currt money of maryland his damages af.^d in form afd 391 acknowledged as also Pounds of tobacco for his Costs
