159 Which award being read and heard and by the Court here fully understood It is Considered by the Court here that the af.d Francis Tate recover against the af.d George Russell ^in Custody as afd^ the af.d twelve pound Curr.t money of Maryland his damages 389 af.d by the Arbitrators af.d in form af.d found as also Pounds of tobacco for his Costs and Charges af.d to the same Francis by the Court now here of his Assent adjudged and the af.d George Russell in Custody as afd in mercy &c
of November Anno Dom one thousand seven hundred and forty to answer unto Francis Allen Gent of a plea of trespass upon the Case &a and the same day is given to the af.d Francis here &c Att which day here Came the af.d Francis Allen by William Arbuckle his attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the afd Peter Taylor whose body hereat this day he had ready to answer the af.d Francis Allen of the afd Plea as to him it was Commanded Whereupon the af.d Peter Taylor puts in his place George Douglas Gent attorney at Law against the af.d Francis Allen of the af.d Plea And thereupon at the request of the parties af.d day is to them now here given untill next Court to be held at dividing Creek in and for the County af.d the third of March then next Following in the same state as at present saveing to the parties af.d &.a Att which day here Came again as well the af.d Francis Allen as the af.d Peter Taylor by their attorneys af.d and hereupon the said Francis Allen Complained against the afd Peter Taylor in the plea af.d in form Following Somerset ss Peter Taylor ^Jr^ Late of Somerset County Planter was attached to answer unto Francis Allen Gentleman of a plea of a plea of trespass upon the Case &.a And Whereupon the same Francis by William Arbuckle his attorney Complains that whereas the same Francis by the space of twenty year Last past was and now is one of the attornies of the Court of the right Honourable the Lord Proprietary of Somerset County and the said Francis as an attorney of the Court af.d by all the time af.d Justly and honestly himself behaved and in that time the same Francis many Causes suits and actions for divers Leige Subjects of our Lord the King now and his predecessors Clients of the same Francis as their Attorney in the said |
