1741 157 damnifyed and damage hath to the Value of One hundred and twenty pounds Currt money of maryland and thereof he brings suit &.a Pledges &.a J Doe and R Roe And the af.d Nathaniel Jackson by George Douglas his attorney Cometh and defendeth the force and Injury when &.a and saith that he Cannot deny the action af.d of the af.d Robert Allan nor Can he say but that the writing ^obligatory^ af.d is the deed of the same Nathaniel nor Can he say but that he owes the same Robert the af.d Eighty pounds Currt money of Verginia of the Value of One hundred and twenty pounds Currt money of maryland in manner and form as the af.d Robert above against him hath declared Therefore it is Considered that the af.d Robert Allen Recover against the af.d Nathaniel Jackson his debt af.d and his damages by occasion of the detention of the same debt to Pounds of tobacco to the same Robert of his Assent by the Court here adjudged and the af.d Nathaniel in Mercy &.a And afterward to witt the eighteenth day of August Anno Dom one thousand seven hundred and forty one Came hereinto Court the af.d Nathaniel Jackson in his proper person and being asked if he was the same person the same Nathaniel against whom the above Judgment was Recovered acknowledged he was and thereupon the said Nathaniel is Committed to the prison of the sheriffe of the County af.d thereto Remain untill the af.d Robert Allan of the debt and damages af.d should be fully satisfied the said Sheriffe to witt John Handy Gent present herein Court in his proper person took Charge of the said Nathaniel accordingly &.a
Nathaniel the fifth day of March Anno Dom Seventeen hundred and forty forty one by his Certain writing obligatory which the same Robert sealed with the seal of the af.d Nathaniel Here here into Court brings whose date is the day and year af.d acknowledged himself to be held and firmly bound to the same Robert in the af.d Sum of twenty pounds Curr.t money of Verginia to be paid to the same Robert when he should be thereto afterwards required Nevertheless the af.d Nathaniel (altho' often required) the af.d Sum to the same Robert hath not as yet paid but the same to pay hath hitherto altogether refused and still doth refuse Whereupon the same Robert saith he is damnified and damage hath to the Value of forty five pounds Currt money of Maryland and thereof he brings |
