154 Heath was Summoned to answer unto George Douglas of a plea that he render him Six pounds Currant money of Maryland which to him he Owes and Unjustly detaines &.a And whereupon the said George by William Arbuckle his attorney says that whereas the said Abraham on the xiij day of July Anno Dom MDCCXL at the County aforesaid by the Certains writing Obligatory which the said Geo sealed with the seal of the said Abraham here into COurt brings whose date is the say and Year afd did acknowledge himselfe to be held and firmly bound to the said George in the said Six pounds to be paid to the said George when he the said Abraham should be afterwards thereto required and to the payment thereof did bind himselfe and his heirs and by that Writing Nevertheless the said Abraham the said Six pounds to the said George hath not rendered but that to doe hitherto hath deny'd and Still doth deny and Unjustly detain altho' thereto afterwards to witt the xxiv day of march in the year aforesaid at the County aforesaid and Often Since that time by the said George required to the dammage of him the said George ten pounds Curr.t money of Maryland and thereof he brings suit &a Pledges &.a Jno Doe R Roe A Copy of the foregoing declaration was made and Sent to be Served on the defend.t with the writ aforesaid in order for a speedy Tryall Att which day here Came the aforesaid George Douglas by his attorney aforesaid and the Sheriffe to witt John Handy Gentleman now here returned that he had Taken the aforesaid Abraham Heath whose body here at this day he had Ready to answer the aforesaid George Douglas of the afd plea as to him it was Commanded And further the afd Sheriffe Returned that he had Served the aforesaid Abraham with a Copy of the foregoing declaration according to act of assembly in Such Case made and provided &a And Whereupon the aforesaid Abraham Heath in his proper person Cometh and defendeth the force and Injury when &.a and Saith that he Cannot deny the action aforesaid of the aforesaid George Douglas nor Can he say but that he Oweth the Same George the aforesaid Six pounds Currant money of Maryland in manner and form as the aforesaid George above against him declared Therefore it is Considered that the aforesaid George Douglas Recover against the aforesaid Abraham Heath his debt aforesaid and his damages by Occasion of the detention of that Same debt to 407 pounds of tobacco to the Same George of his assent by the Court here adjudged and the aforesaid Abraham in Mercy &.a
Caldwell of a plea that he render unto him twenty pounds Cash maryland Currency and two hundred and Seventy pounds of tobacco which to him he owes and unjustly detained &.c and the same day is given to the af.d Joshua here &c And hereupon the said Joshua Caldwell declared against the said Thomas Fletcher in the plea af.d in form Following Somerset |
