further it is Considered that the af.d Hutton Hill Administrator of the af.d Johnson Hill recover against the af.d John Purnall
158   One hundred and fifty Eight                              pounds of tobacco for his Costs and Charges by him about his defence
af.d in this part sustained to the same Hutton by the Court here Adjudged According to the form of the statute thereof
lately made and provided and the same Hutton have thereof Execution &c

     Command was given to the Sheriffe of Somerset County that he should
take William Pilchard Late of Sommerset County planter if he Should
be found in his bailywick and him should safe keep so that he might have
his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third
Tuesday of March Anno Dom one thousand seven hundred and forty to answer unto Arthur Warick of a plea of trespass upon
the Case &c and the same day is given to the af.d Arthur here &c

                      Att which day here Came the af.d Arthur Warwick by Robert Jenckins Henry his Attorney and the sheriffe to witt
John Handy Gent now here returned that he had taken the af.d William Pilchard whose body here at this day he had ready to
Answer the af.d Arthur Warwick of the af.d plea as to him it was Commanded

             Whereupon the af.d William Pilchard puts in his place George Douglas Gent Attorney at Law against the af.d Arthur
Warwick of the af.d plea
                                              And thereupon at the request of the parties af.d day is to them now here given untill next
Court to be held at dividing Creek in and for the County af.d the third Tuesday of June then next Following in the same state as at
present saveing to the parties af.d &c

                       Att which day here Came again the af.d William Pilchard by his Attorney af.d and the af.d Arthur Warwick altho'
Solemnly Called Came not nor ^is^ his writ af.d against the af.d William Pilchard further prosecuted &c

                     Therefore he and his pledges of prosecuting are in mercy and let the said Arthur Warwick name pledgeds &c and
that the af.d William Pilchard goe thereof without day  Also it is Considered that the af.d William Pilchard recover against the af.d
164    Arthur Warwick his damages by Occasion of the premisses to:                                                                           pounds of
tobacco to the same William by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according
to the form of the statute in such Case lately ^made and^ provided by the Court here adjudged &c
