                         June Court                               1741                                   137

in account as by account thereof hereto annexed may appear and soe being thereof Indebted on Consideration thereof
afterwards to wit the day and year af.d to the County af.d the said James in his life upon himself assumed and to the said John then
and there promise to pay to the said John the said Eight Thousand four hundred Eighty and nine pounds of tobacco when he
 should be afterwards thereto required and altho' the said James in his life did pay to the said John five thousand Eight hundred
pounds of tobacco part of the said Eight thousand four hundred Eighty and nine pounds of tobacco  Nevertheless as to two
thousand six hundred Eighty and nine pounds of tobacco residue of the said Eight thousand four hundred Eighty and nine pounds
of tobacco the said James in his life his promise af.d in form af.d made not regarding but minding and fraudulently intending the
said John in that part Craftily and subtilly to deceive and defraud the said Residue to the said John the said James in his life did
not pay but that to doe altogether did refuse and the said Margaret since the death of the said James the said residue to the said John
hath not paid but that to doe altogether hath refused and still doth refuse altho' the said residue to the said John to pay the said James in his
life afterwards to witt on the day and year af.d at the County af.d and the said Margaret since the death of the said James the said residue
to the said John to pay afterwards to wit the first day of may Anno Dom MDCCXXXvii at the County af.d and often since that
time by the said John were severally required  Whereupon the said John says he is damnifyed five thousand pounds of tobacco and
