137 so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of march Anno Dom one thousand seven hundred and forty to answer unto Sayward Tomlinson of a plea of trespass upon the Case &.c and the same day is given to the af.d Seward here &c Att which day here Came the af.d Seward Tomlinson by Robert Jenckins Henry his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Francis Henderson whose body here at this day he had ready to answer the af.d Seward Tomlinson of the af.d plea as to him it was Commanded Whereupon the af.d Francis Henderson puts in his place George Douglas gent Attorney at Law against the af.d Seward Tomlinson of the af.d plea And thereupon at the request of the parties af.d day is to them now here given untill next Court to be held at dividing Creek in and for the County af.d the third tuesday of June the next Following in the same state as at present saveing to the parties af.d &c Att which day here Came again the af.d Francis Henderson by his Attorney af.d and the af.d Seward Tomlinson altho' Solemnly Called Came not nor ^is^ his writ af.d against the af.d Francis Henderson further prosecuted &c Therefore he and his pledges of prosecuting are in mercy and let the said Seward Tomlinson name pledges &c and that the af.d Francis Henderson goe thereof without day also it is Considered that the af.d Francis Henderson recover against the af.d Seward Tomlinson his damages by Occasion of the premisses to pounds of tobacco to the same Francis by discretion of the Justices here at his request for his Costs and Charges in that part sustained according to the form of the statute in such Case lately made and provided by the court he adjudged &c
before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of march Anno Dom One thousand Seven hundred and forty to answer unto John Purnall of a plea of trespass upon the Case &.a and the Same day is given to the aforesaid John here &a And the said John Purnall Complained against the aforesaid Margaret Lindow in the plea aforesaid in form following Somerset ss Margaret Lindow late of Somerset County widdow administratrix of all and Singular the goods Chattles and Credits which were of James Lindow late of Sommerset County deceased who died Intestate was attached to answer unto John Purnall of a plea of trespass upon the Case &a And whereupon the said John by George Douglas his attorney Complaines that whereas the said the said James in his Life to witt on the first day of May Anno Dom MDCCXXXi at the County aforesaid was Indebted to the said John in Eight thousand four hundred eighty and nine pounds of tobacco for Sundry matters properly Chargeable in |
