133 Ordered by the Court here that Charles Dashiell Recover against Thomas Nevett Ninety pounds of tobacco being due unto him for his attendance three days as an evidence on behalf of the said Thomas Nevett against George Russell he haveing made oath to the same &.a Ordered by the Court here that W.m Nelson and Solomon Dennis Recover against John Wildman One hundred and twenty pounds of tobacco each being due unto each of them for their attendance four days each as evidences on behalf of the said John Wildman at suit of Archibald M.ccNeal they haveing made oath to the same &.a Ordered by the Court here that Henry Reynolds Recover against John Wildman two hundred and Seventy pounds of tobacco being due unto him for his attendance nine days as an evidence on behalf of the said John Wildman at suit Archibald M.ccNeal he haveing made oath to the same &.a
to answer unto Joseph Ennalls of a plea of trespass upon the Case &c and the same day is given to the af.d Joseph here &c Att which day here Came the af.d Joseph Ennalls by ^Francis Allen^ his Attorney af.d and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d John Evans whose body here at this day he had ready to answer the af.d Joseph Ennalls of the af.d plea as to him it was Commanded And hereupon the said Joseph Ennalls declared against the af.d John Evans in the plea af.d in form Following Somerset County ss John Evans Sent late of Somerset County planter was attached to answer unto Joseph Ennalls of a plea of trespass upon the Case &c And Whereupon the said Joseph by Francis Allen his Attorney Complains that whereas the said John after the first day of may Anno Dom seventeen hundred and five to witt on the third day of Novr Anno Dom Seventeen hundred and thirty Eight at the County of Somerset af.d within the Jur of this Court made his Certain note in writing Called a promissory note with his proper hand Subscribed bearing date the same day and year last mentioned and the said note to the said Joseph then and there deliver'd by which said note the said John did Acknowledge to have received of the said Joseph four pounds in bills of Creditt Curr.t money which said money or the Like Sum or Quantity of four pounds he promissed to return or repay again to the said Joseph on the last day of April next Ensuing the said third day of November and by reason thereof as also by force of the statute in that Case lately made and provided the said John became Chargeable to pay to the said Joseph the said Sum of money according to the tenor of the said note and so being Chargeable the said John in Consideration thereof afterwards |
