123 Taylors Accot of Fees for he (the said Francis again meaning) hath both Charged (him the said Peter meaning) and I (the said ^John^ himself meaning) fees in one Cause (a certain suit wherein the af.d Peter Taylor was plantiff and the af.d John def.t meaning) by pretext of the speaking and publishing the af.d false feigned and scandalous words Sundry of the Clients of him same Francis who him the same Francis before that time had retained to prosecute and defend divers Causes and Suits in the af.d County of Somerset here him the same Francis lately desert and leave and him as their Attorney further to retain or Imply by Occasion thereof utterly refuse by reason whereof divers Sums of money which from his Clients af.d he might have lawfully and Honestly acquired or may acquire he hath totally last Whereupon the same Francis saith he is damnified and damage hath to the Value of five hundred pounds Curr.t money of Maryland and thereof he brings suit &c Pledg.s &c Jn.o Doe Ri: Roe And the af.d John Evans by George Douglas his Attorney Comes and defends the force and Injury when &.c and prayeth leave thereof to Imparle here untill next Court to be held at dividing Creek the third Tuesday of June then next Following and he hath it and the same day is given to the af.d Francis here also &c Att which day here Came again as well the af.d Francis Allen as the af.d John Evans by their Attorney af.d and thereupon the said John Evans saith that he Cannot deny the action aforesaid of the aforesaid Francis Allen nor Can he Say but the he spoak the words of the afd Francis in the declaration afd mentioned and the same John Acknowledged that the Same words were false and further the Same John says that the said Francis Ought to recover his damages by Occasion of the Speaking and uttering of the words aforesaid beyond his Costs and Charges by him about his Suit in this part Expended to Twenty pounds Currant Mony of Maryland and not more and because the aforesaid Francis denys not this but the Same allegation grants to be true prays Judgmt for those damages afd above acknowledged together with his Costs and Charges aforesaid to him to be adjudged Whereupon the aforesd Francis freely here in Court remitteth unto the aforesaid John the afd Twenty pounds Curr.t money of Maryland the damages afd by the afd John in form afd Acknowledged Therefore the Same John of the aforesaid twenty pounds be thereof quiet &c Therefore it is Considered that the aforesaid Francis Allen Recover against the afd John Evans the aforesaid Twenty pounds Curr.t money of Maryland his damages aforesaid in form afd acknowledged as 371 also three hundred and ninety three pounds of tobacco for his Costs and Charges aforesaid to the same Francis by the Court here of his assent adjudged and the afd John in Mercy &c
County Court of Somerset to be held at dividing Creek the third Tuesday of November Anno Dom one thousand seven hundred and forty to answer unto John Newbold of a plea of trespass upon the Case &.c and the same day is given to the af.d John here &c Att |
