122 dividing Creek the third Tuesday of November Anno Dom one thousand seven hundred and forty to answer unto Francis Allen one of the Attorneys of the said Court of a plea of trespass upon the Case &c and the same day is given to the af.d Francis here &c Att which day here Came the af.d Francis Allen by William Arbuckle his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d John Evans whose body here at this day he had ready to answer the af.d Francis Allen of the af.d plea as to him it was Commanded Whereupon the af.d John Evans puts in his ^place^ George Douglas Gent Attorney at Law against the af.d Francis Allen of the af.d plea And thereupon at the request of the parties af.d day is to them now here given untill next Court to be held at dividing Creek the third tuesday of March then next next Following in the same state as at present saving to the parties af.d &c Att which day here Came again as well the af.d Francis Allen as the af.d John Evans by their Attorney af.d and hereupon the said Francis Allen Complained against the af.d John Evans in the plea af.d in form following Somerset ss John Evans late of Somerset County planter was Attached to answer unto Francis Allen ^one^ of Attorneys of his Lordships County Court of a plea of trespass upon the Case &c And Whereupon the same Francis by William Arbuckle his Attorney Complains that whereas the same Francis by the space and time of twenty years last past and more was and now is one of Attorneys of the Court of the Right Honrble the Lord proprietary of Somerset County and the same Francis as an Attorney of the court af.d by all the time af.d Justly sincerely and faithfully himself behaved and in that time the same Francis many Causes suits & actions for divers Liege Subjects of our Lord the King now and his predecessors Clients of the same Francis as their Attorney in the said Court of Somerset here faithfully and according to the best of his skill and knowledge had prosecuted and defended and by reason of the fidelity honesty care and skill of the same Francis in the management of the Causes suits and business of his Clients af.d divers subjects of our Lord the King and his predecessors the same Francis to be their Attorney and their Accons and suits in the Court af.d to prosecute and defend daily did retain by which the same Francis Attorneys Fees and other large sums of money for the management of their affairs lawfull and honestly gained to the plentifull Support of him and his family and the same Francis from all False dealing and fraudulently practice or takeing fees and rewards on both sides by all the time af.d hitherto free Clear unspotted & unsuspected hath remained Nevertheless the af.d John not Ignorant of the premisses but falsely and maliciously plotting and intending the same Francis unjustly to aggrieve and him into scandal Ignominy and publick shame as well among his Clients as other subjects of our Lord the King now to ^whom^ him the same Francis was known to bring and likewise to Cause the Clients of the same Francis him as a villian and a Cheat to desert and leave ^and^ him as their Attorney no longer to retain and also him the said Francis of such fees and profits which he from his Clients af.d might reasonably gain totally to deprive the day of in the year of our Lord seventeen hundred and forty at Somerset County af.d in the presence and hearing of many Liege Subjects of our Lord the King now upon a discourse then and there had of and Concerning some Attorneys fees Charged by the same Francis on the af.d John these false feigned scandalous and opprobious words Following of the said Francis falsely and maliciously said and published Viz.t Frank Allen (the af.d Francis Allen meaning) is a Villian for he (the same Francis again meaning) takes Fees on both sides and I (the said John himself meaning will prove it by Peter Taylors |
