115 John Handy Gent now here returned the af.d writ thereof endorsed in these words Following I have attached the goods within named of the value within mentioned of the goods of Tarrel Brown in the writ hereto annexed mentioned which I have ready before the Justices in the said writ named as by the said writ I am Commanded and I further Certify that the said Tarrel Brown has no other goods Chattles or Creditts within my bailywick which I can attach for the purposes in the said writ named so answers John Handy Sheriffe A Schedule of the Goods and Chattles of Tarrel Brown attached for the use of Cap.t David Wilson and appraised by William Dixon Benjamin Lankford Stephen Horsey Jun.r and Henry Smith being first duely sworn to make a Just and true appraisment thereof and have vallued them as followeth to witt
The above Goods and Chattles were appraised and valued this 26.th day of June One thousand seven hundred and forty one by us W.m Dixon Stephen Horsey J.r Benjamin Lankford Henry Smith Whereupon the aforesaid David Wilson in his proper person present here in Court prays that upon giving of security to act of assembly in such Case made and provided the aforesaid Cow and Calfe and One Two Years Old heffer of the value of Two hundred and Twenty five pounds of tobacco and One pound five Shillings Curr.t money of Maryland so as aforesaid attached may be Condemned as the goods and Chattles of the said Tarrell Brown towards Satisfiying unto him the aforesaid Twenty four Shillings and Eight pence Currt money and all Costs and Charges Expended on the attachment aforesaid Thereupon Thomas Hayward of Sommerset County present herein Court in his proper person undertook for the said David Wilson according to act of assembly in such Case made and provided that in Case the said Tarrell Brown do at any time within a year and a day appear and make all or any part of the said David Wilsons Claim against him appear to be satisfied or have been undue before the Laying of this attachment that then the said David Wilson shall make Restitution unto the said Tarrel Brown of all or such part thereof as the said Tarral shall make appear to be undue &.a or that he the said Thomas Hayward will do it for him &.a Therefore it is Considered by the Court here that the aforesaid Cow and Calfe and One Tow Years Old heifer all of the value of Two hundred and Twenty five pounds of tobacco and One pound five shillings Currant money so as aforesaid attached be Condemned as the goods and Chattles of the aforesaid Tarrell Brown towards Satisfying unto the aforesaid David Wilson the aforesaid One pound four shillings and Eight pence Curr.t money and all Costs and Charges Expended by means of the attachment aforesaid and that the said David have thereof Execution &a |
