This day to witt the 14th day of Aprill 1741
Came Cap.t John Newbold in his proper
person and made oath on the holy Evangelist
of Almighty God that the above Account as it
stands stated is Just and true and that he never
received part or percell of the above Acct more
then Credit given for nor ^Security^ nor Satisfaction for the
same        Sworn before  Samuel Hopkins

    A Copy of the foregoing declaration was made and sent to be served on the Deft with the writt in the plea af.d 

Att which day here Came the af.d John Newbold by his Attorney af.d and the sheriffe to witt John Handy Gent now here returned
that he had taken the af.d Paul Alexander whose body here at this day he had ready to answer the af.d John Newbold of the af.d plea as
to him it was Commanded      And further the said sheriffe returned that he had served the af.d Paul Alexander with a Copy of the
foregoing declaration according to Act of Assembly in such Case made and provided &c

                   Whereupon Came hereinto Court a Certain Nicholas Fountain of back Creek & Thomas Reyley both of Somerset
County ^planters^ in their proper persons and undertook and each of them undertook for the said Paul Alexander (Likewise the said Paul
Alexander present here in Court in his proper person Assumed upon himself) that if it should happen that Judgment in the plea af.d
should be rendred for the same John against the said Paul or that he the said Pail should be therein Convict that then he the said
Paul should pay and satisife unto the said John the Judgment of the Court thereupon or render his body in execution of such
Judgment to the prison of the sheriffe of the County af.d in satisfaction thereof or that they the same Nicholas Fountain &
Thomas Reyley will do the same for him &c

                   And the af.d Paul Alexander by William Arbuckle his Attorney Comes and defends the force and Injury when &c
and saith that he Cannot deny the Action af.d of the af.d John Newbold nor but that he did Assume upon himself in manner &
form as the af.d John above against him hath Complained and as to the damage of the same John by him by Occasion of the
premisses in that part Sustained the said John Paul saith and acknowledgeth that the af.d John hath sustained damages by
occasion of the premisses beyond his Costs and Charges by him about his suit in this part apposed to three pounds fifteen
