108 may answer upon which the aforesaid James hath day given him by the Court here to answer unto the afd Benjamin untill Thursday the third day of this term and the Same James at the Same day altho' Solemnly Called to answer Came not nor Saith nothing in barr or preclusion of the action aforesaid of the aforesaid Benjamin by which the Same Benjamin Remaineth agt the said James thereof undefended &.a By Reason whereof the same Benjamin his damages by Occasion of the non performance of the promise and assumption aforesaid against the aforesaid James Ought to recover Whereupon at the prayer of the Same Benjamin and of the Consent of the aforesaid James the Justices here according to Act of Assembly in Such Case made and provided assessed the damages of the Same Benjamin by Occasion of the non performance of the promise and assumption afd beyond his Costs and Charges by him about his Suit in that part apposed to five pounds Currant money of Maryland &a Therefore by Consent of the parties aforesaid It is Considered that the aforesaid Benjamin Warrington Recover against the aforesaid James Townsend his damages aforesaid to the afd five pounds Curr.t money of Maryland by the Justices afd in form aforesaid assessed as also five hundred and forty six pounds of tobacco for his Costs and Charges aforesaid to the Same Benjamin at his request by the Court now here adjudged which Certain damages in the whole amounts to five pounds Curr.t money of Maryland and five hundred & forty six pounds of tobacco and the afd James in Mercy &c You James Townsend Saul Townsend and Solomon Townsend do Confess Judgment unto Benjamin Warrington for the sum of five pounds Current money of Maryland and Five hundred and forty six pounds of tobacco which sum was recovered by the said Benj.a Warrington against James Townsend on the Sixteenth day of June in the County Court of Somerset before the Justices thereof at dividing Creek which said sum of Five pounds Curr.t money of Maryland and Give hundred and forty Six pounds of tobacco to be levied of your bodys goods or Chattles lands or tenements for the use of the Benjamin Warrington in Case the said James Townsend shall ^not^ pay and Satisfie to the said Benjamin Warrington the said sum of Five pounds Curr.t money of Maryland and Five hundred and forty Six pounds of tobacco so as af.d recovered against him with additionall Costs thereon on the tenth day of November next Taken before us this 18th day of June 1741 Jn.o Scott W.m Lane
