89 known unto the Justices of his Lordships County Court of Somerset here what damages the same Ezekiel in that part hath sustained therefore it is Commanded the sheriff that by the oath of honest and Lawfull men of his bailywick or County he diligently Inquire what damages the same Ezekiell hath sustained as well by occasion of the Non performance of the promise and assumption afd as for his Costs and Charges by him about his Suit in that part apposed and the Inquisition which thereupon he should take he make appear to the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of August then next following under his seal and the Seals of those by whose Oath he take that Same Inquisition he send together with his Lordships writt thereof to him directed &c & the same day is given to the afd Ezekiel there &c
of his Lordships County Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of June ann Dom One thousand Seven hundred and thirty Seven to answer unto Robert Graham of a plea of trespass upon the Case &.c and that thereof he Should not fail &c And hereupon the said Robert Graham by Geo Douglas his attorney declared against the said William Wye in the plea afd in form following viz.t Somerset ss.t William Wye Late of Somerset County Clerk was attached to answer unto Robert Graham of a plea of trespass upon the Case &c And whereupon the said Robert Graham by George Douglas his attorney Complaines that whereas the said William on the Twenty second day of Janry ann Dom Seventeen hundred and thirty five at the County of Somerset within the Jurisdiction of this Court did Buy of ye said Robert sundry goods and merchantdize in an acco.t thereof hereto annexed mentioned and on Consideration thereof afterwards to witt the day and year afd at the County afd upon himselfe did assume and to the said Robert then & there faithfully promise that he the said W.m would pay to the said Robert as much money as the said Goods and merchantdise were reasonably worth and the said Robert in fact says that the said goods and merchantdise were reasonably worth nine pounds four Shillings and Six pence Curr.t money of Maryland of which the |
