    June Court               1737         82

body before the Justices of his Lordships County Court of Somerset to be held at dividing
Creek in the County aforesaid the third tuesday of march Anno Dom one thousand seven
hundred and thirty six to answer unto Giddion Tilman of a plea of trespass upon the
Case &c  and that thereof he should not fail &c

    Att which day here before the Justices of his Lordships County Court of Somerset at dividing
Creek Came the af.d John White by Francis Allen his attorney and the sheriffe of the
County af.d to witt John White whose body here at this day he be had ready to answer the af.d
Giddion Tilman of the af.d plea as to him it was Commanded &c

    And the said John White by Francis Allen his attorney Cometh hereinto Court and thereupon
at the request of the parties day is given to the parties af.d to before the Justices
of his Lordships County Court of Somerset at dividing Creek the third tuesday of June then
next following in the state wherein they now are saving to the parties af.d &c

    att which day here Came the af.d John White by his attorney af.d and the said Giddion
Tilman his writt af.d against the af.d John White didnd not prosecute   Therefore he
and his pledges of prosecuting being mercy and Lett the plf.t name pledges &c and that
the af.d John White goe thereof without day also it is Considered that the af.d John
White Recover against the af.d Giddion Tilman his damages by occasion of the
premisses to                                                                                 pounds of tobacco
164   to the same John White by discretion of the Justices here at his request for his
Costs and Charges in that part sustained according to the form of the statute thereof
lately made and provided by the Court here adjudged and that the same John have
thereof Execution &c
