1737 82 right ought to be duely executed Wee Command you that by honest and lawful men of you bal bailywick you make known to the af.d Henry Miles that he be and appear before our Justices of our County Court of Somerset to be held at dividing Creek in the County af.d the third tuesday of march next to shew cause if anything for himself he hath or to say knoweth wherefore the af.d W.m Colebourn his Execution of the debt and damages af.d to have ought not according to the form of the Recovery af.d if to him it seemeth Expedient and have you there the Names of those before whom to him you make known and this writt Wittness Robert King Gen.t Chief Justice of our said Court the 22.d day of december in the twenty second year of our Dominion &c Anno Dom one thousand seven hundred and thirty six Att which day before the Justices of his Lordships County Court of Somerset at dividing Creek Cometh the afd William Colebourn by Francis Allen his attorney and the the Sheriffe of the County afd to witt Joseph McClester Gent at the same day returned that by virtue of the writt afd to him directed he had made known unto the afd Henry Miles by Francis Porter and John Doe honest and Lawfull men of his Bailywick that he be before his Lordships Justices at the day and place afd to shew &.c as within to him it was Commanded And whereupon the afd William prays Execution against the afd Henry of the debt and damages afd in form afd to him to be adjudged &.c And the afd Henry Miles by William Beckingham his attorney Cometh and prayeth Leave thereof to Imparle hereuntill the third Tuesday of June then next following and he hath it and the same day is given to the afd William here also &c Att which day to witt the third Tuesday of June Cometh as well the afd William Colebourn as the afd Henry Miles by their attorneys afd and whereupon the same William as before prays Judgmt Execution against the afd Henry of the debt & Damages afd to him to be adjudged &c And the Same Henry on the same day altho' Solemnly Called Cometh not Therefore it is Considered that the aforesaid William Colebourn have Execution against the afd Henry Miles of the debt and damages afd by the same Henry's default &c
