68 Justices on their proper persons undertook and Each of them undertook for the Same John Bishop and assumed upon themselves (Likewise the Same John Bishop present herein Court in his proper persons assumed upon himself) that if it Should happen that judgm.t in the plea afd in the Same Court Should be rendered for the Same John Atkinson against him the said John Bishop or that he the said Josh Bishop should be therein Convicted that then he the said John Bishop should pay and Satisfie unto the said John Atkinson the Judgm.t of the Court thereupon or render his body in Execution of such Judgm.t to the prison of the Sheriff of the County afd thereto remaine untill the Same Judgm.t be fully satisfied or that they the Same John Selby and Dennis Hudson will do the Same for him And the aforesaid John Bishop by Robert Jenckins Henry his attorney Cometh and defendeth the force and Injury when &c And the afd John Atkinson prays that the Same John Bishop to his declaration afd may answer Whereupon the Same John Bishop hath day to him given by the Court here untill fryday then next ^to witt^ the fourth day of this term to answer unto the declaration afd of the afd John Atkinson in the plea afd and the Same John Bishop at the Same day Solemnly Called to answer Cometh not nor the Same attorney of the afd John Bishop for the Same John nothing thereof saith in bar or perclusion of ye action afd of the afd John Atkinson by which the Same John Atkinson remaineth thereupon against him undefended &c Therefore it is Considered that the aforesaid John Atkinson recover against the afd John Bishop his debt afd and his damages by occasion of the detention of the same debt to five hundred and Sixteen pounds of tobacco to the Same John Atkinson of his assent by the Court here adjudged and the aforesaid John Bishop in mercy &c
June anno Dom One thousand Seven hundred and thirty Seven to answer unto Thomas Purnall of a plea of trespass upon the Case &.c And that there^of^ he Should not fail &c and hereupon the said Thomas Purnall by Geo Douglas his attorney declared against the same William Wye in the plea afd in form following Somerset ss.t William Wye late of Somerset County Clerk was attached to answer unto Tho.s Purnall of a plea of trespass upon the Case &c And whereupon the said Thomas by Geo Douglas his attorney complains that whereas the said W.m after the first day of may Anno Dom seventeen hundred and five to witt on the twentyeth day of June Anno Dom seventeen hundred thirty and four at Somerset County af.d did make his certain note in writing called a promissary note with his proper hand hand subscribed bearing date the day and year last mentioned and the said note to the said Tho.s Purnall then and there did deliver by which note the said W.m did promise to pay to the said Tho.s by me |
