68 to be held at dividing Creek in the Same County the third Tuesday of June anno Dom One thousand Seven hundred and thirty Seven to answer unto John Atkinson of a plea that he render unto him two thousand One hundred and Seventy pounds of ^good^ Pork and two hundred & Eighty pounds of good tobacco which from him he unjustly detaines &c and that thereof he should not fail &c And the afd John Atkinson by Francis Allen his attorney declared hereupon against the said John Bishop in the plea afd as followeth vizt Somerset County ss.t John Bishop Jun.r late of Somerset County planter al dict John Bishop Jun.r of Somerset County in the province of Maryland planter was summoned to answer unto John Atkinson of a plea that he render unto him two thousand one hundred and seventy pounds of good pork and two hundred and eighty pounds of good tobacco which from him he unjustly detains &c And whereupon the said John Atkinson by Francis Allen his attorney saith that whereas the said John Bishop the nineteenth day of March Anno Dom one thousand seven hundred and thirty four five at the County of Somerset af.d within ^the^ Jurisdiction of this Court by his certain writing obligatory which the said John Atkinson with the seal of the said John Bishop signed hereinto Court brings the date whereof is the same day and year did acknowledge himself to be bound unto the said John Atkinson in the af.d in the af.d two thousand one hundred and seventy pounds of good pork and two hundred and eighty pounds of good tobacco to be paid to the said John Atkinson when he should be thereunto required yett the said John Bishop tho often required the said two thousand one hundred and seventy pounds of good pork and two hundred and eighty pounds of good tobacco to the said John Atkinson hath not rendred but the same to him hitherto to render hath denyed and still doth deny and unjustly detain to the damage of the said John Atkinson twenty pounds Curr.t money of Maryland and thereupon he brings suit &c Pledges &.c Jn.o Doe & R Roe A Copy of the foregoing declaration was made and sent to be served on the said John Bishop with the writt afd according to act of assembly in such Case provided &c Att which day here before the Justices of his Lordships County Court of Somerset at dividing Creek Came the said John Atkinson by his attorney afd and the Sheriffe of the Same County to witt Joseph MccClester Gent at the same day here returned that he had taken the afd John Bishop whose body here at this day he had ready to answer the afd John Atkinson of the afd plea as to him it was Commanded And whereupon a Certain John Selby and Dennis Hudson of Somerset County planter present herein Court before the afd (Justices) |
