45 Ordered that Thomas Caldwell recover against John Mitchell one hundred and fifty pounds of tobacco being due unto him for his attendance five days as an Evidence on behalfe of his Lordship against the said John Mitchell he having made oath to the same &c Wonney MaClemmey Executor of Eliza Nicholson dec.d being sumoned to appear at this Court to give Security for the ballance of the said decds Estate &c Came here into Court and made it appear to the satisfaction of the Same Court that the Ballance of the said Estate did Intirely belong to himselfe &c Thereupon the said Wonney Macclemmey is discharged from the same somons and from giveing away Saint for the same Ballance &c [illegible] Smith admrx of John Smith being somoned to appear at this Court to give security for the Ballance of the said decds Estate &c Came here into Court and made it appear to the Satisfaction of the Same Court that the Same John Smith had no Legal representatives other than her selfe to secure the Same Ballance to thereupon the said Mary Smith is discharged &c Abigail Smith administx of Mary Donas dec.d being Somoned to appear at this Court to give Security for the ballance of the said decds Estate &c Came hereinto Court and made it appear to the Satisfaction of the Court that she had fully paid above all the Estate of the same Mary Save Such part as doth belong to herself &c thereupon the said abigail is discharged from giving any security &c Mary Smith Executrix of John Smith dec.d being Sumoned to appear at this Court to give Security for the ballance of the said decds Estate &c Came into Court here a Certain John Gornwell who had Intermarried with the afd Mary Smith the Exrx and did make it appear to the Satisfaction of the Court that he had paid away the Estate of the afd Jno Smith dec.d to the Representatives of the same John &c Thereupon they are discharged from giving any Security for the same ballance &c
The Severall writts belonging to the above actions were returned Cepi p the Sheriffe of Somerset County and were Entered agreed and Countermanded and Struck of on March Court Dockett anno Dom 1736 |
