298 Judgment to the said Joshua Caldwell with twenty two pounds of tobacco additionall Costs according to act of assembly in such case provided whereof he is Convict &.a And the same day is given to the af.d Joshua there &.a Att which day here Came the said Joshua Caldwell in his proper person and the sherriffe of Somerset County to witt John Henry Gent at the same day here returned that he had taken the af.d Joseph Macclester whose body hereat this day he had ready to satisfie the af.d Joshua Caldwell of the money and tobacco af.d as af.d he was Commanded &a
of Somerset to be held at dividing Creek in the Same County the third Tuesday of June Ann Dom One thousand Seven hundred and thirty Eight to Satisfie Richard Gildart Esq.r of Seven thousand Four hundred and Eleven pounds of tobacco which Sum the said Francis Porter Joseph Macclester & Littleton Townsend before Robert King and John Scott Gentlemen two of his Lordships Justices of the County afd the peace to keep assigned did on the twenty Ninth day of July Ann Dom one thousand Seven hundred and thirty Seven Confess Judgment to the afd Richard Gildart Esq.r with twenty two pounds of tobacco addition Costs of Suit according to act of assembly in Such Case made and provided whereof he is Convict &a and the same day is given to the afd Richard there &a Att which day Came here as well the afd Richard Gildart in his proper person as the afd Francis Porter in his Proper person and the same Francis being by the afd Sheriffe Ledd to the Barr by Virtue of the writt afd to him there of directed and being by the Court ^here^ asked if he was the very same Francis the same person which the afd Richard of the tobacco afd was Convicted or not who says that he is Therefore the Same Francis Porter is Committed to the prison of the Sheriffe of the County ^afd^ thereto remaine in safe Custody untill the same Richard of the tobacco afd should be fully satisfyed and paid &a |
