26 matter in dispute between them (arisen by means of an attachment purchased out of this Court by the af.d John Williams and a Condemnation thereupon had in the same Court of the goods and Chatteles of the said Martin Fenton in the hands of him the said John) unto a Certain Geo Douglas and Robert Jenckins Henry of the County af.d Gen.t and if they the said Arbitrators cannot agree in the premisses that then they the said Arbitrators to make Choice of a third person and their award in the premisses af.d between the parties af.d to be returned to his Lordships Justices at dividing Creek the third tuesday of August then next following that the same Justices may proceed thereon to Judgment &c and the same day is given to the parties af.d there &c Att which day here Came againe as well the aforesaid John Williams as the afd Martin Fenton in their proper persons and the aforesaid Arbitrators sends not their award in the premisses afd therefore further day is Given to the arbitrators here untill the third Tuesday of November then next following for the making & returning of their award in the premisses afd and the same day is Given to the afd parties thereof &c Att which day here Came againe as well the afd John Williams as the afd Martin Fenton in their proper persons and the aforesaid Arbitrators sends not their award in the the premisses aforesaid therefore further day is given to the arbitrators here untill the third tuesday of March then next following for the making and returning of their award in the premisses aforesaid and the Same day is given to the parties afd there &c Att which day here Came as well the afd John Williams as the aforesaid Martin Fenton in their proper persons and the afd Geo Douglas and Robert Jenckins Henry arbitrators afd sends here at the same day their award in the premisses afd in form following Whereas John Williams and Martin Fenton by Rule of Somerset County Court made in June last (According to the form of the Statute in that Case provided) did Submit a Certain matter in the said Court depending between them by means of his Lordships Writt of attachment levied at the suit of the said John Williams on the goods and Chattells of the said Martin Fenton and wee having pursuant to such Submission taken upon us the determination of the premisses doe award that the said Martin Fenton doe pay to the said John Williams the sum of eight pounds Curr.t money of the province of Maryland in the whole gold or silver on or before the twentieth day of this present |
