257 Should be found in his bailywick and him should safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of March Ann Dom One thousand Seven hundred and thirty seven to Satisfie William Sandwith of Seven pounds Curr.t Money of Maryland and three hundred & Sixty pounds of tobacco which to the Same William in the Same Court before the Justices thereof at dividing Creek afd were adjudged for his damages which he had by occasion of a Certain promise and assumption to the same Will.m by the afd Ebenezer made and not performed whereof he is Convict &a Att which day here Came the afd Will.m Sandwith by George Douglas his attorney afd and the Sheriffe of Somrset County to witt John Henry Gent at the same day here returned that he had taken the afd Ebenezer whose body here at this day he had ready to satisfie the afd W.m of his damages afd as afd he was Commanded &a John Deal being Somoned to appear at this Court to give Security for the Ballance of the Estate of William Stephenson dec.d according to act of assembly in Such Case provided &a the said John Deal being present herein Court in his proper person and made it appear to the satisfaction of the Court here that there was noe Legall representative other than himselfe to have and receive the said Estate &a thereupon the said John Deal is discharged from the said Subp.a from giveing any Security for the Same &a Mary Ennis Executrix of the testament and Last will of Charles Bishop Late of Somerset County dec.d being Summoned to appear at this Court to give Security for the Ballance of the Estate of the said Charles Bishop dec.d according to act of assembly in such Case provided &a the said Mary Ennis appeared herein Court in her proper person and made it appear to the Satisfaction of the Same Court here that she had paid away all the Estate of the Said Charles Bishop that he had Given by his testament afd Save what he had given unto her Selfe &.a Thereupon the said Mary Ennis is discharged by the Court here from the Subpena afd from giveing any Security for the same Estate &a James Nearn Executor of the testament of Robert Nairn decd being Sumoned to appear at this Court to Answer give Security for Ballance of the Said Robert Nairns Estate &a the said James Nairn appeared here in Court in his proper person and made it appear to the Satisfaction of the Court here that the Estate was given Intirely to himselve save Some small matters that he had paid away &a Thereupon the said James Nearn is discharged by the Court here from giveing any Security for the said Ballance &a John White of Pocomoke Executor of Thomas Beachamp dec.d being Sumoned to give Security for the Ballance of the Said Thos Beachamps Estate &a the said John White present herein Court in his proper person made |
